HEMA, J.\n         - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                         B.A. No. 6471 of 2008\n         - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 23rd day of October,2008\n\n                                   O R D E R\n<\/pre>\n<p>       Petition for bail.\n<\/p>\n<p>       2. The alleged offences are under section 379 read with<\/p>\n<p>section 34 IPC.      According to prosecution, petitioner (A2) along<\/p>\n<p>with 1st accused committed theft of a fishing boat, which was kept<\/p>\n<p>at the fishing harbour. Petitioner was arrested on 27-8-2008 and<\/p>\n<p>he is in custody since then.\n<\/p>\n<p>       3. Learned Public Prosecutor submitted that petitioner is<\/p>\n<p>not a native of Kerala. He hails from Tamil Nadu and it is likely<\/p>\n<p>that he will abscond. Therefore, bail may not be granted. It is<\/p>\n<p>also submitted that charge-sheet has been laid.<\/p>\n<p>       4. On hearing both sides, I am satisfied that petitioner is<\/p>\n<p>not required for investigation. At the same time, it is likely that<\/p>\n<p>petitioner may not be available, if he is granted bail. But, there is<\/p>\n<p>no reason to refuse bail. Conditions can be imposed to ensure<\/p>\n<p>that he will be available for trial. Hence, bail is granted to the<\/p>\n<p>petitioner on the following terms and conditions:-<\/p>\n<blockquote><p>              1)     Petitioner shall be released on bail on his<\/p>\n<p>                      executing a bond for Rs.25,000\/- with two<\/p>\n<p>                      solvent sureties each for the like amount<\/p>\n<p>                      to    the     satisfaction      of    the     learned<\/p>\n<p>BA 6471\/08                         -2-\n<\/p><\/blockquote>\n<blockquote><p>                  Magistrate.   The sureties     shall be local<\/p>\n<p>                  sureties and the learned Magistrate shall<\/p>\n<p>                  explain the consequences of breach of<\/p>\n<p>                  condition to the sureties personally.<\/p>\n<\/blockquote>\n<blockquote><p>           2)    Petitioner    shall    report    before   the<\/p>\n<p>                 Investigating Officer on every alternate<\/p>\n<p>                 day between       5 p.m. and 8 p.m. until<\/p>\n<p>                 further orders.\n<\/p><\/blockquote>\n<blockquote><p>           3)    Petitioner shall not leave the limits of the<\/p>\n<p>                 police station within which the crime is<\/p>\n<p>                 registered until the trial is over, except<\/p>\n<p>                 with the prior permission of the learned<\/p>\n<p>                 Magistrate.\n<\/p><\/blockquote>\n<blockquote><p>           4)     Petitioner shall not commit any offence<\/p>\n<p>                 while on bail and in case breach of this<\/p>\n<p>                 condition, bail is liable to be cancelled.<\/p>\n<p>      This petition is allowed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                              K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<blockquote><p>mn.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Jagadish vs State Of Kerala on 23 October, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6471 of 2008() 1.
