Justice V.GIRI\n\n Dated :04\/07\/2008\n\n O R D E R\n                             V.GIRI,J.\n                      -------------------------\n                 W.P ( C) No. 14204 of 2008\n                      --------------------------\n                Dated this the 4th July, 2008\n\n                        J U D G M E N T\n<\/pre>\n<p>      Petitioner retired from the Chengannur Municipality<\/p>\n<p>as Superintendent on 30.6.2007. By Exhibit-P1, terminal<\/p>\n<p>leave   surrender    benefits    were     sanctioned to  the<\/p>\n<p>petitioner. By Exhibit-P2, DCRG and Commuted Value of<\/p>\n<p>Pension    were sanctioned.      Petitioner is aggrieved by<\/p>\n<p>notwithstanding the order of sanction except the pension,<\/p>\n<p>other amounts are yet to be received.<\/p>\n<p>      2.   First respondent has filed a statement. It is<\/p>\n<p>clear that no liability as such         is fixed against the<\/p>\n<p>petitioner.   The stand taken by the Municipality is that<\/p>\n<p>amounts are due to the Municipality from the State and<\/p>\n<p>that has not been disbursed in full. In the meanwhile, in<\/p>\n<p>Exhibit -P2, the Director has directed the Municipality to<\/p>\n<p>pay the amounts due to the petitioner from the amounts<\/p>\n<p>due from the Municipality to the State by way of<\/p>\n<p>contribution to the Central Pension Fund.               This<\/p>\n<p>W.P ( C) No. 14204 of 2008<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>according to the learned counsel for the Municipality is<\/p>\n<p>unjustified.\n<\/p>\n<p>      3.     I heard learned counsel for the petitioner and<\/p>\n<p>learned Government Pleader and learned standing counsel<\/p>\n<p>for the 1st respondent Municipality.<\/p>\n<p>      4.       Exhibit-P2 order passed by the       Director is<\/p>\n<p>categoric and as long as it remains, it is binding on the<\/p>\n<p>Municipality as well. In the circumstances, the Municipality<\/p>\n<p>is bound to disburse the DCRG and Commuted Value of<\/p>\n<p>Pension due to the petitioner in terms of Exhibit-P2.<\/p>\n<p>Petitioner has a claim for revision of retirement benefits<\/p>\n<p>and the same is pending orders as Exhibit-P7 before the<\/p>\n<p>Director.     The Director will have to take a decision on this<\/p>\n<p>aspect.\n<\/p>\n<p>      5.     In the result, the writ petition is disposed of in<\/p>\n<p>the following terms:\n<\/p>\n<blockquote><p>             i)    First respondent shall disburse to the<\/p>\n<p>      petitioner the amount sanctioned under Exhibit-P2<\/p>\n<p>      within a period of two months from the date of receipt<\/p>\n<p>      of a copy of this judgment.\n<\/p><\/blockquote>\n<p>W.P ( C) No. 14204 of 2008<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>      ii)    First respondent shall also pay the salary arrears<\/p>\n<p>      due to the petitioner on the basis of Exhibit-P6 within<\/p>\n<p>      the aforementioned time frame.\n<\/p>\n<p>      iii)   Second respondent shall pass orders on Exhibit-<\/p>\n<p>      P7 within a period of three months from the date of<\/p>\n<p>      receipt of a copy of this judgment.
