Justice R.BASANT\n\n Dated :29\/06\/2007\n\n O R D E R\n                                     R.BASANT, J.\n\n                                  ----------------------\n\n                               B.A.No.3926  of 2007\n\n                            ----------------------------------------\n\n                     Dated this the  29th   day of June 2007\n\n\n                                       O R D E R\n<\/pre>\n<p>       Application  for  anticipatory   bail.     The  defacto   complainant   is  a<\/p>\n<p>police   constable,   who   was   on   duty   in   connection   with   the   Pooram<\/p>\n<p>festival of a temple.   Four named persons allegedly had attacked the<\/p>\n<p>defacto   complainant.     Crime   was   registered   against   four   specified<\/p>\n<p>persons   inter   alia   under   Section   353   I.P.C.   which   is   the   only   non-<\/p>\n<p>bailable   offence   alleged.     The   petitioner   is   not   one   of   those   four<\/p>\n<p>named   accused   persons.     In   the   course   of   investigation,   the   police<\/p>\n<p>have   deleted   accused   3   and   4   and   have   filed   a   report   incorporating<\/p>\n<p>two   others   including   the   petitioner   as   accused.     The   petitioner<\/p>\n<p>apprehends   imminent  arrest.    The  learned  counsel  for  the  petitioner<\/p>\n<p>submits   that   the   petitioner   is   absolutely   innocent.     False   allegations<\/p>\n<p>are   being   raised   against   the   petitioner   without   any   justification.     In<\/p>\n<p>these circumstances, at any rate, directions under Section 438 Cr.P.C<\/p>\n<p>may be issued in favour of the petitioner, he prays.<\/p>\n<p>       2.     The   learned   Public   Prosecutor   submits   that   the   report   to<\/p>\n<p>array   the  petitioner  as an  accused  has   already   been  filed  before  the<\/p>\n<p>learned Magistrate.  Investigation is complete and the final report has<\/p>\n<p>also   been   filed,   it   is   further   submitted.     In   the   peculiar   facts   and<\/p>\n<p>circumstances of this case and there is no serious objection from the<\/p>\n<p>learned Public Prosecutor, the petitioner can be granted anticipatory<\/p>\n<p>bail subject to appropriate terms and conditions.<\/p>\n<p><span class=\"hidden_text\">B.A.No.3926\/07                               2<\/span><\/p>\n<p>       3.      In the result, this petition is allowed.   The petitioner shall<\/p>\n<p>be released on bail on the following terms and conditions.<\/p>\n<p>       i)      Petitioner   shall   surrender   before   the   learned   Magistrate<\/p>\n<p>having jurisdiction at 11 a.m on 07\/07\/2007.\n<\/p>\n<\/p>\n<p>       ii)     He  shall   be  released  on  regular   bail  on  condition that  he<\/p>\n<p>execute bond for Rs.25,000\/-(Rupees twenty five thousand only) with<\/p>\n<p>two   solvent   sureties   each   for   the   like   sum   to   the   satisfaction   of   the<\/p>\n<p>learned Magistrate.\n<\/p>\n<\/p>\n<p>       iii)    The   petitioner   shall   make   himself   available   for<\/p>\n<p>interrogation before the investigating officer   between 10 a.m and 12<\/p>\n<p>noon   on   09\/07\/2007   and   thereafter   as   and   when   directed   by   the<\/p>\n<p>investigating officer  in writing to do so.\n<\/p>\n<\/p>\n<p>       (iv)    If   the   petitioner   does   not   appear   before   the   learned<\/p>\n<p>Magistrate   as   directed   in   clause   (i),   directions   issued   above   shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to   arrest<\/p>\n<p>the petitioner and deal with them in accordance with law, as if these<\/p>\n<p>directions were not issued at all.\n<\/p>\n<\/p>\n<p>       (v)     If   he   was   arrested   prior   to   07\/07\/2007,   he   shall   be<\/p>\n<p>released   on   bail   on   his   executing   a   bond   for   Rs.25,000\/-   (Rupees<\/p>\n<p>twenty   five   thousand   only)   without   any   sureties,   undertaking   to<\/p>\n<p>appear before the learned Magistrate on 07\/07\/2007.<\/p>\n<pre>\n\n\n\n\n\n                                                               (R.BASANT, JUDGE)\n\njsr\n\n\n                              \/\/ True Copy\/\/          PA to Judge\n\n\n<span class=\"hidden_text\">B.A.No.3926\/07    3<\/span>\n\n\n<span class=\"hidden_text\">B.A.No.3926\/07    4<\/span>\n\n\n       R.BASANT, J.\n\n\n\n\n\n         CRL.M.CNo.\n\n\n\n\n\n            ORDER\n\n\n\n\n\n21ST DAY OF MAY2007\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sunil.P. vs State Of Kerala Represented By on 29 June, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 3926 of 2007() 1.
