Nikub), P.P.\n\n\n      Heard learned counsel for the petitioners\n\nas    well    as     learned    Public       Prosecutors       and\n\nperused the material\/case diary made available\n\nto me during the arguments of the case.\n\n      These three bail applications arise out of\n\nFIR     No.     39\/09      Police          Station        Bhadesar\n\n(Chittorgarh)         therefore,           they     are     being\n\ndisposed of by this common order. So far as\n\nbail application No. 3143\/09 on behalf of the\n\npetitioner Puran Giri and bail application No.\n\n3330\/09 on behalf of two accused persons Satu\n\nGiri @ Satya Narayan                and Suresh Chandra are\n\nconcerned, learned counsel for the petitioners\n\nsubmits       that    he   does      not    press    both      the\n                                    2\n\napplications at this stage and liberty may be\n\ngranted        to     them    to        file    a      fresh        bail\n\napplication after framing of charges against\n\nthem    by     the    trial   court.           Hence,    the        bail\n\napplications No. 3143\/09 filed by Puran Giri\n\nand bail application No. 3330\/09 filed by Satu\n\nGiri @ Satya Narayan                   and Suresh Chandra are\n\ndismissed as not pressed with liberty to file\n\nfresh bail application after framing of charges\n\nagainst them by the trial court.\n\n       So far as petitioner Ratan Lal S\/o Shanti\n\nLal Mali is concerned, learned counsel for the\n\npetitioner          contended      that        there     were       two\n\nprosecution witnesses namely Gurmeet Singh and\n\nSwarn Singh          and they both do not identify him\n\nand no recovery has been made at his instance\n\nunder Section 27 of the Evidence Act.\n\n       Learned Public Prosecutor does not dispute\n\nthe above facts.\n\n       After        considering         the     submissions          of\n\nlearned counsel for the parties, examining the\n\nrecord and the facts and circumstances of the\n\ncase, but without expressing any opinion on its\n\nmerits and demerits, I think it fit and proper\n\nto allow        the bail      application           of Ratan Lal\n\nunder     Section       439     Cr.P.C.          Hence,        it    is\n\ndirected that accused-petitioner namely Ratan\n                             3\n\nLal     S\/o Shanti Lal Mali, be released on bail\n\nunder    Section   439   Cr.P.C.,      in    C.R.
