Sushila Paliwal, GA for State.\n\n      ORDER RESERVED ON          29\/04\/2011.\n\n      ORDER PASSED ON            04\/05\/2011.\n\n                        ORDER\n<\/pre>\n<p>      This petition has been filed under Section 482 of<\/p>\n<p>Cr.P.C.to invoke the extra ordinary jurisdiction of this<\/p>\n<p>Court to expunge the adverse remarks passed against<\/p>\n<p>petitioner Sanjay Dwivedi in paragraph 20 of judgment<\/p>\n<p>dated 16.09.08 delivered in ST No. 143\/2008 by the 6th<\/p>\n<p>Addl.Sessions Judge to the Court of 2nd Addl. Sessions<\/p>\n<p>Judge, Sagar, Camp at Rahli.\n<\/p>\n<p>(2)   Learned counsel appearing for petitioner submitted<\/p>\n<p>that petitioner was the Incharge of PS-Garhakota,<\/p>\n<p>District-Sagar.   In the instant case, the Investigating<\/p>\n<p>Officer Krishnkant Mishra who was posted as ASI at the<\/p>\n<p>relevant time conducted the entire investigation, only<\/p>\n<p>challan was filed by the petitioner in the case, and in the<\/p>\n<p>trial of ST No.143\/08 said Krishnkant Mishra was<br \/>\n<span class=\"hidden_text\">                            -2-<\/span><\/p>\n<p>examined as a prosecution witness no.7. Petitioner was<\/p>\n<p>never examined and no opportunity was given to him of<\/p>\n<p>being heard and certain remarks were passed against<\/p>\n<p>him by the learned trial Judge in his judgment in para 20<\/p>\n<p>in which not only strictures were passed against<\/p>\n<p>Krishnkant Mishra, but at the same time, strictures were<\/p>\n<p>also passed against the petitioner and a departmental<\/p>\n<p>enquiry was ordered to be initiated and it was expected<\/p>\n<p>that petitioner will be punished.\n<\/p>\n<p>(3)   Learned counsel for petitioner has placed reliance<\/p>\n<p>on a judgment of Apex Court in <a href=\"\/doc\/564691\/\">A.M.Mathur vs. Pramod<\/p>\n<p>Kumar Gupta and others<\/a> (1990) 2 SCC 533 wherein it<\/p>\n<p>has been held that adverse comments without giving an<\/p>\n<p>opportunity of hearing to the person concerned were<\/p>\n<p>unwarranted, unjustified and without jurisdiction and<\/p>\n<p>therefore, must be expunged.\n<\/p>\n<p>      Learned counsel for petitioner has further placed<\/p>\n<p>reliance on a judgment of this Court in K.P. Singh<\/p>\n<p>Kushwaha vs. State of M.P. 2005 (2) MPHT 423 in<\/p>\n<p>which it has been held that where during trial while<\/p>\n<p>acquitting the accused certain adverse remarks were<\/p>\n<p>made in the judgment against the conduct of the<\/p>\n<p>Investigating Officer and trial Court also gave directions<\/p>\n<p>to police authority for initiation of departmental enquiry<br \/>\n<span class=\"hidden_text\">                                  -3-<\/span><\/p>\n<p>and to punish him without giving opportunity to show<\/p>\n<p>cause, such action of trial Court was not proper, it was<\/p>\n<p>held that trial Court has no jurisdiction to direct the<\/p>\n<p>authority for initiation of DE and to punish the applicant.<\/p>\n<p>(4)   From        perusal   of   judgment    delivered    in   ST<\/p>\n<p>No.143\/08, it is clear that no opportunity of hearing was<\/p>\n<p>provided to the petitioner though learned GA appearing<\/p>\n<p>for State has supported the judgment and adverse<\/p>\n<p>remarks, but legally such remarks cannot be allowed to<\/p>\n<p>stand as no opportunity of hearing was given to<\/p>\n<p>petitioner which is against the principle of natural<\/p>\n<p>justice. I find present to be a fit case to invoke the extra<\/p>\n<p>ordinary jurisdiction of this Court under S.482 Cr.P.C.by<\/p>\n<p>expunging the adverse remarks made against petitioner<\/p>\n<p>Sanjay Dwivedi.
