M. SAHAI)<\/p>\n<p>We<br \/>\n\thave heard Mr. Dakshesh Mehta, learned counsel for the petitioner.\n<\/p>\n<p>\tThis<br \/>\n\tpetition has been filed for the following reliefs :-\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships may be pleased to issue a writ of mandamus or any other<br \/>\nappropriate writ, order or direction directing the respondent<br \/>\nauthorities to take appropriate action and to verify the record<br \/>\nregarding the awards passed in favour of the father of the petitioner<br \/>\nand to further pass necessary award for Survey Nos.222 and 224 and<br \/>\npay the amount of award along with interest, to the petitioner.\n<\/p>\n<p>(B)\tPending<br \/>\nadmission, hearing and final disposal of this writ petition, Your<br \/>\nLordships may be pleased to verify the record and submit the<br \/>\ninformation regarding the awards passed in favour of the father of<br \/>\nthe petitioner, before this Hon&#8217;ble Court;&#8221;\n<\/p>\n<p>The<br \/>\n\tland was acquired in the year 1970 for construction of residential<br \/>\n\thouses for the staff of Dharoi Dam Project. The father of the<br \/>\n\tpetitioner died in the year 2007 and then the petitioner came to<br \/>\n\tknow from his old diary that compensation for acquiring the land for<br \/>\n\tSurvey No.222 and 224 was not paid.  The petitioner prays that the<br \/>\n\trecords may be verified and compensation along with interest<br \/>\n\tbe paid.\n<\/p>\n<p>\tIt<br \/>\n\tis not disputed that father of the petitioner died in the year 2007<br \/>\n\tand the land was acquired in the year 1970. The father of the<br \/>\n\tpetitioner never claimed any compensation during his life time for a<br \/>\n\tperiod of 27 years.\n<\/p>\n<p>In<br \/>\n\tour opinion, at such a belated stage, this petition cannot be<br \/>\n\tentertained as it has been held by the Apex Court in the case of<br \/>\n\tState<br \/>\n\tof Orissa and another v. Mamta Mohanty, (2011) 3 SCC 436<br \/>\n\tin paragraphs 52 to 54 as under :-\n<\/p>\n<p>\t\t&#8220;DELAY\/LACHES<br \/>\n:-\n<\/p>\n<p>52.      In<br \/>\nthe very first appeal, the respondent filed Writ   Petition on<br \/>\n11.11.2005 claiming relief under the Notification   dated 6.10.1989<br \/>\nw.e.f. 1.1.1986 without furnishing any explanation for such<br \/>\ninordinate delay and on laches on her part. Section 3 of the<br \/>\nLimitation Act 1963, makes it   obligatory on the part of the court<br \/>\nto dismiss the Suit or appeal if made after the prescribed period<br \/>\neven though the limitation is not set up as a defence and there is no<br \/>\nplea to  raise the issue of limitation even at appellate stage<br \/>\nbecause in some of the cases it may go to the root of the matter.<br \/>\n(See : Lachhmi Sewak Sahu v. Ram Rup Sahu &amp; Ors., AIR 1944 Privy<br \/>\nCouncil 24; and Kamlesh Babu &amp; Ors. v. Lajpat Rai Sharma &amp;<br \/>\nOrs, (2008) 12 SCC 577).\n<\/p>\n<p>33.<br \/>\nNeedless to say that Limitation Act 1963 does not apply in writ<br \/>\njurisdiction. However, the doctrine of limitation being based on<br \/>\npublic policy, the principles enshrined therein are applicable and<br \/>\nwrit petitions are dismissed at initial stage on the ground of delay<br \/>\nand laches. In a case like at hand, getting a particular pay scale<br \/>\nmay give rise to a recurring cause of action. In such an eventuality,<br \/>\nthe petition may be dismissed on the ground of delay and laches and<br \/>\nthe court may refuse to grant relief for the initial period in case<br \/>\nof an unexplained   and inordinate delay. In the instant case, the<br \/>\nrespondent claimed the relief from 1.1.1986 by filing a petition on<br \/>\n11.11.2005 but the High Court for some unexplained reason granted the<br \/>\nrelief w.e.f. 1.6.1984, though even the   Notification dated<br \/>\n6.10.1989 makes it applicable w.e.f. 1.1.1986.\n<\/p>\n<p>54.    This<br \/>\nCourt has consistently rejected the contention that a petition should<br \/>\nbe considered ignoring the delay and laches in case the petitioner<br \/>\napproaches the Court after coming to   know of the relief granted by<br \/>\nthe Court in a similar case as   the same cannot furnish a proper<br \/>\nexplanation for delay and laches.   A litigant  cannot wake up from<br \/>\ndeep slumber and claim impetus from the judgment in cases where some<br \/>\ndiligent person had approached the Court within a reasonable time.<br \/>\n(See:  <a href=\"\/doc\/1133181\/\">M\/s Rup Diamonds &amp; Ors., v. Union of India &amp;   Ors.,<br \/>\nAIR<\/a> 1989 SC 674;  <a href=\"\/doc\/619596\/\">State of Karnataka &amp; Ors. v. S.M. Kotrayya &amp;<br \/>\nOrs.,<\/a> (1996) 6 SCC 267; and Jagdish Lal &amp; Ors. v. State of<br \/>\nHaryana &amp; Ors., AIR 1997 SC 2366).\n<\/p>\n<p>Since<br \/>\n\tthe petitioner is guilty of delay and laches, no relief can be<br \/>\n\tgranted to him.
