           These applications are for anticipatory bail. The<\/p>\n
petitioners face allegations in a crime registered alleging<\/p>\n
offences punishable, inter alia, under sections 452, 354 and<\/p>\n
323 IPC. The crux of the allegations is that the 1st accused<\/p>\n
had entrusted a mobile phone with the de facto complainant<\/p>\n
for sale thereof.      The same was allegedly sold but the<\/p>\n
proceeds were not handed over to A1.                  Because of this<\/p>\n
animosity,   the    three     accused      persons       allegedly had<\/p>\n
trespassed into the residential building of the de facto<\/p>\n
complainant.     He was allegedly assaulted and hurt was<\/p>\n
caused to him. The mother of the de facto complainant was<\/p>\n
allegedly assaulted indecently. The incident took place on<\/p>\n
6.1.08.   Crime has been registered.                Investigation is in<\/p>\n
progress. The petitioners apprehend imminent arrest.<\/p>\n

      2.   The learned counsel for the petitioners submit that<\/p>\n
the petitioners are innocent. In fact, the disputes have been<\/p>\n
settled between the de facto complainants(CWs 1 and 2, the<\/p>\n
son and the mother) and the petitioners. He has no grievance<\/p>\n
now.    He has sworn to an affidavit before an Advocate. In<\/p>\n
these circumstances, anticipatory bail may be granted to the<\/p>\n
petitioners, it is prayed.\n<\/p>\n
      3.   Notice was given to the learned Public Prosecutor.<\/p>\n
The learned Public Prosecutor, after taking instructions,<\/p>\n
submits that to the best knowledge of the investigator no bona<\/p>\n
fide settlement has taken effect. It is submitted that the de<\/p>\n
facto complainant and his mother were threatened to submit<\/p>\n
that there is no willing and voluntary settlement. In these<\/p>\n
circumstances, the alleged settlement may not be reckoned<\/p>\n
as a relevant circumstance to grant anticipatory bail to the<\/p>\n
petitioners. In any view of the matter, the petitioners may not<\/p>\n
be granted anticipatory bail, it is submitted.<\/p>\n
      4.   The learned counsel for the petitioners submit that<\/p>\n

the investigating officer has animus against the petitioners<\/p>\n
and that is why such stand is taken by the investigating<\/p>\n
officer. The learned counsel for the petitioners pray that the<\/p>\n
petitioners may be given an opportunity to surrender before<\/p>\n
the learned Magistrate and seek regular bail without the<\/p>\n
threat\/risk of their arrest by the police and going into police<\/p>\n
custody except through court.\n<\/p>\n
      5.   Having considered all the relevant circumstances, I<\/p>\n
am satisfied that directions under section 438 Cr.P.C. can be<\/p>\n
issued in favour of the petitioners to enable them to surrender<\/p>\n
before the learned Magistrate and seek regular bail without<\/p>\n
the threat and risk of arrest by the police and incarceration<\/p>\n
before they go into the custody of the court. They can, I am<\/p>\n
satisfied, be given an opportunity to surrender before the<\/p>\n
learned Magistrate and seek regular bail.<\/p>\n
      6.   In the result, these petitions are allowed. Following<\/p>\n
directions are issued under Section 438 Cr.P.C in favour of<\/p>\n
the petitioners.\n<\/p>\n

\n                                : 4 :<\/span><\/p>\n
     i)    Petitioners shall surrender before the learned<\/p>\n
Magistrate having jurisdiction at 11 a.m on 17.3.08. They<\/p>\n
may, after giving prior notice to the Prosecutor in charge of<\/p>\n
the case, apply for bail. The learned Magistrate must pass<\/p>\n
appropriate orders on such application by the petitioners and<\/p>\n
any other application to be filed by the police. The petitioners<\/p>\n
shall thereafter abide by the orders to be passed by the<\/p>\n
learned Magistrate.\n<\/p>\n
     (ii)  If the petitioners do not appear before the learned<\/p>\n
Magistrate as directed in clause (i), directions issued above<\/p>\n
shall thereafter stand revoked and the police shall thereafter<\/p>\n
be at liberty to arrest the petitioners and deal with them in<\/p>\n
accordance with law, as if these directions were not issued at<\/p>\n
all.\n<\/p>\n
     (iii) If they were arrested prior to 17.3.08, they shall be<\/p>\n
released from custody on their executing a bond for<\/p>\n
Rs.25,000\/- undertaking to appear before the learned<\/p>\n
Magistrate on 17.3.08.\n<\/p>\n

\n                                : 5 :<\/span><\/p>\n
      7.   The learned Public Prosecutor submits that he has<\/p>\n
information that the 1st accused has already been arrested by<\/p>\n
the police in connection with some other case. The learned<\/p>\n
counsel for the 1st accused is not sure of that circumstance. If<\/p>\n
the 1st accused has been so arrested, needless to say, the<\/p>\n
police or the petitioner can move the court concerned to get<\/p>\n
his arrest recorded in the instant case and then seek regular<\/p>\n
bail.\n<\/p>\n
      8.   Needless to say, it shall be open to the petitioners<\/p>\n
to satisfy the learned Magistrate      that Cws 1 and 2 have<\/p>\n
willingly and voluntarily settled the disputes and compounded<\/p>\n
the offence.\n<\/p>\n<\/p>\n
