That construction of commercial building\/flat which is being done in unauthorized manner going<br \/>\n      on at F-44, Samas Pur Road, Pandav Nagar, Delhi-110092, has its map been passed as per the<br \/>\n      rules by the DDA?\n<\/p>\n<p>2.    If map has been passed then for how many varg gaj it has been passed?\n<\/p>\n<p>3.    Whether the map passed is commercial or residential map?\n<\/p>\n<p>4.    If its being constructed in an unauthorized manner without a map then what action has been taken<br \/>\n      as per DDA Act?\n<\/p>\n<p>5.    Has any report been filed in the Police Station against this unauthorized construction?\n<\/p>\n<p>6.    Has area police registered any complaint against this unauthorized construction?\n<\/p>\n<p>7.    Was any complaint lodged to Deputy Commissioner, Superintendent Engineer, Executive<br \/>\n      Engineer, DDA, Shahdara South against this unauthorized construction?\n<\/p>\n<p>8.    What action was taken against this unauthorized construction on 30\/03\/2009?\n<\/p>\n<p>9.    Which officer is investigating on the complaint of 30\/03\/2009? Give the name and the designation<br \/>\n      of the officer.\n<\/p>\n<p>PIO&#8217;s Reply:\n<\/p>\n<p>PIO gave the information which the Appellant alleged to be wrong.<br \/>\n Order of First Appellate Authority:\n<\/p>\n<p>FAA ordered PIO to provide information to the Appellant within ten days.\n<\/p>\n<p>Grounds for Second Appeal:\n<\/p>\n<p>The Appellant has alleged that the PIO has not provided any information till date.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. Kaliram Tomar<br \/>\nRespondent: Mr. Pushkar Sharma, SEII, PIO, Shahdara South; Mr. SP Tanwar, EE (B)-II, APIO<br \/>\nThe then PIO had given the information that as per records no building construction had been<br \/>\nsanctioned on the said plot. The Appellant had filed a complaint about an illegal construction of a four<br \/>\nstoreyed building being in progress but the then PIO Mr. Ranvir Singh had given the information that<br \/>\nthere was no complaint on record. The Appellant alleges that is systematic modus operandi in which<br \/>\nwithout any authorization or permissions buildings are constructed in collusive collaboration with<br \/>\nMCD engineers. the Appellant states that inspite of complaints, MCD officers act as if the construction<br \/>\nactivities are invisible and when the building in complete it is claimed that the building has been in<br \/>\nexistence before and the Delhi Govt.&#8217;s blanket immunity to illegal works before 2007 is used to allow<br \/>\nthese buildings to continue without any hindrance. The Appellant has brought a photograph of the<br \/>\nbuilding being constructed at that site.\n<\/p>\n<p>The Commission orders a joint inspection of the site on 23\/09\/2009 at 11 am. Mr. SP Tanwar and the<br \/>\nAppellant will conduct the joint inspection, take photographs of the site and make minutes of the<br \/>\nmeeting to record the existing position.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>The joint inspection report with photographs will be prepared and a copy given to the Appellant and<br \/>\nthe Commission before 25\/09\/2009.\n<\/p>\n<p>This decision is announced in open chamber.\n<\/p>\n<p>Notice of this decision be given free of cost to the parties.<br \/>\nAny information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005.\n<\/p>\n<p>                                                                                                   Shailesh Gandhi<br \/>\n                                                                                         Information Commissioner<br \/>\n                                                                                                18 September 2009<\/p>\n<p>                 (In any correspondence on this decision, mentioned the complete decision number.)
