DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/12\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered at<br \/>\n\tC.R.No.I &#8211; 26 of 2010 with Okha Police Station, Jamnagar for<br \/>\n\tthe offences punishable under Sections 307, 325, 504, 506(2), 143,<br \/>\n\t147 and 148 etc. of the Indian Penal Code and Section 135(1) Bombay<br \/>\n\tPolice Act.\n<\/p>\n<p>Mr.M.\n<\/p>\n<p>\tJ. Buddhbhatti, learned counsel appearing for the applicant submits<br \/>\n\tthat the charge-sheet is filed and there are allegations of<br \/>\n\tinflicting stick blow and thereby causing injuries on hands and<br \/>\n\tknees, which resulted into fracture, therefore, it cannot be said<br \/>\n\tthat the applicant had intention to kill the deceased and now the<br \/>\n\tinvestigation is over, the applicant may be enlarged on regular<br \/>\n\tbail.\n<\/p>\n<p>Mr.Kartik<br \/>\n\tPandya, learned APP for the respondent &#8211; State submits that<br \/>\n\tthe role of the applicant in inflicting the injuries has surfaced on<br \/>\n\trecord by filing of charge-sheet and the injured was hospitalized<br \/>\n\tfor about 24 days and after treatment, he was discharged and,<br \/>\n\ttherefore, the applicant may not be enlarged on bail.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perused the record of the<br \/>\n\tcase and considered the facts and circumstances of the case and<br \/>\n\tnature of allegations levelled against the applicant and usage of<br \/>\n\tstick mostly on hands and knees and a fracture is noticed, at this<br \/>\n\tstage when the charge-sheet is filed,  I am inclined to enlarge the<br \/>\n\tapplicant on bail.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is  ordered to be released on bail in connection<br \/>\n\twith First Information Report registered at C.R.No.I &#8211; 26 of<br \/>\n\t2010 with Okha Police Station, Jamnagar, on executing bond of<br \/>\n\tRs.5,000\/- [Rupees Five Thousand Only]  with one surety of the like<br \/>\n\tamount to the satisfaction of the trial Court and subject to the<br \/>\n\tconditions that he   shall;\n<\/p>\n<p>\t(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender his<br \/>\npassport, if any, to the lower Court within a week;\n<\/p>\n<p>(d)\tnot leave the State<br \/>\nof Gujarat without prior permission of the Sessions Judge concerned;\n<\/p>\n<p>(e)\tmark his presence at<br \/>\nthe concerned Police Station on the first Sunday of every month<br \/>\nbetween 10.00 a.m and 3.00 p.m for three months only;\n<\/p>\n<p>(f)\tfurnish the present<br \/>\naddress of residence to the Investigating Officer and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicants only of  he is not required<br \/>\n\tin connection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extend.
