Justice M.SASIDHARAN NAMBIAR\n\n Dated :27\/07\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.2370 of 2009\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioners are the accused in C.C.No.576\/2006<\/p>\n<p>on the file of Judicial First Class Magistrate&#8217;s<\/p>\n<p>Court,  Chalakudy.  Prosecution  case is   that  on<\/p>\n<p>13.2.2006, the Additional Sub Inspector of Police,<\/p>\n<p>Chalakudy Police Station, along with a Probationary<\/p>\n<p>Sub Inspector and two women Constables, conducted a<\/p>\n<p>search in Chungath Towers Lodge and found the<\/p>\n<p>petitioners in Room No.203. Alleging that they were<\/p>\n<p>engaged in prostitution, they were arrested and<\/p>\n<p>Crime No.78\/2006 of Chalakudy Police Station was<\/p>\n<p>registered for offences under Sections 3, 4, 5 and<\/p>\n<p>7  of  Immoral   Traffic  (Prevention)  Act,   1956<\/p>\n<p>(hereinafter referred to as &#8216;the Act&#8217;).       After<\/p>\n<p>completing  the  investigation,  Annexure-D   final<\/p>\n<p>report was submitted, based on which Judicial First<\/p>\n<p>Class Magistrate, Chalakudy took cognizance of the<\/p>\n<p>said offences.\n<\/p>\n<p><span class=\"hidden_text\">CRMC 2370\/09             2<\/span><\/p>\n<p>    2. This petition is filed under Section 482 of<\/p>\n<p>Code of Criminal Procedure to quash the final<\/p>\n<p>report and the proceedings taken by the Magistrate<\/p>\n<p>contending that even if the allegations in the<\/p>\n<p>final report are accepted, no offence is made out<\/p>\n<p>and therefore, it is to be quashed.     It is also<\/p>\n<p>contended that the search and arrest were conducted<\/p>\n<p>not by a Special Police Officer as provided under<\/p>\n<p>the Act and therefore, based on the said search and<\/p>\n<p>arrest, petitioners cannot be prosecuted and in<\/p>\n<p>such circumstances, the case is to be quashed.<\/p>\n<p>    3. Learned counsel appearing for the petitioners<\/p>\n<p>and learned Public prosecutor were heard.<\/p>\n<p>    4. Learned counsel appearing for the petitioners<\/p>\n<p>argued that Additional Sub Inspector of Police is<\/p>\n<p>not a Special Police Officer as provided under the<\/p>\n<p>Act   and   as per  G.O.(MS)No.56\/2002\/Home   dated<\/p>\n<p>24.4.2002, only the Circle Inspector of Police,<\/p>\n<p>attached to the police station is a Special Police<\/p>\n<p>Officer under Section 13(1) of the Act and in such<\/p>\n<p><span class=\"hidden_text\">CRMC 2370\/09             3<\/span><\/p>\n<p>circumstances, proceedings initiated based on the<\/p>\n<p>search    and arrest conducted  by  Additional  Sub<\/p>\n<p>Inspector is not legal and on that reason alone,<\/p>\n<p>the case is to be quashed. It is also argued that<\/p>\n<p>even if the allegations in Annexure-D final report<\/p>\n<p>are accepted, none of the offences alleged is<\/p>\n<p>attracted and therefore, the case is to be quashed.<\/p>\n<p>    5. Learned Public Prosecutor did not dispute<\/p>\n<p>the fact that there is no material to prove that<\/p>\n<p>petitioners were engaged in prostitution, as this<\/p>\n<p>was only the solitary incident.\n<\/p>\n<p>    6. It cannot be disputed that in view of G.O.<\/p>\n<p>(MS)No.56\/2002\/Home dated 24.4.2002, Additional Sub<\/p>\n<p>Inspector of Police, who conducted the search and<\/p>\n<p>arrest of the petitioners, is not a Special Police<\/p>\n<p>Officer as provided under the Act. The effect of a<\/p>\n<p>search and arrest conducted by a Sub Inspector of<\/p>\n<p>Police, who is not a Special Police Officer as<\/p>\n<p>provided under the Act, was considered by this<\/p>\n<p>Court in <a href=\"\/doc\/787834\/\">Sinu Sainudheen v. Sub Inspector of Police<\/p>\n<p><span class=\"hidden_text\">CRMC<\/span><\/a> 2370\/09              4<\/p>\n<p>(2002 (1) KLT 693).   It was held that Sub Inspector<\/p>\n<p>of Police is not competent to conduct the search or<\/p>\n<p>arrest and when it is found that search and arrest<\/p>\n<p>were    conducted   not  in   accordance  with   the<\/p>\n<p>provisions of law and there is no possibility of<\/p>\n<p>the case ending in conviction, the proceedings is<\/p>\n<p>to be quashed. The decision squarely applies to the<\/p>\n<p>facts of this case also.\n<\/p>\n<p>    6.     Moreover, in order to attract an offence<\/p>\n<p>under Section 3 of the Act, there should be an<\/p>\n<p>allegation that petitioners have been keeping or<\/p>\n<p>managing or assisting in keeping or management of a<\/p>\n<p>brothel.    There  is, absolutely,   no  such  case.<\/p>\n<p>Similarly, to constitute an offence under Section<\/p>\n<p>4, petitioners must be living wholly or partially<\/p>\n<p>on the earnings by prostitution.     Prosecution has<\/p>\n<p>no such case also. Similarly, to attract an offence<\/p>\n<p>under   Section   7, there  should  be  evidence of<\/p>\n<p>prostitution.    On the materials produced, there is<\/p>\n<p>nothing to prove that petitioners were engaged in<\/p>\n<p><span class=\"hidden_text\">CRMC 2370\/09             5<\/span><\/p>\n<p>prostitution.  Hence, even if petitioners are to be<\/p>\n<p>tried, there is no likelihood of a conviction.   In<\/p>\n<p>such circumstances, it is not, in the interest of<\/p>\n<p>justice, to continue the proceedings.<\/p>\n<p>     Petition is allowed.
