No ground is made out for restoration of the matter.\n<\/p>\n<p>2.0\tLearned<br \/>\nadvocate Mr. Shaikh submitted that on 6th September 2010<br \/>\nwhen the matter was called out he was busy before another Court and<br \/>\nincidentally, that matter was also adjourned to 8th<br \/>\nSeptember 2010 and therefore, on 8th September 2010, after<br \/>\nremaining present before this Court till 3:30 p.m. he went to attend<br \/>\nthat other matter.\n<\/p>\n<p>2.1\tEven<br \/>\nif it is true, he could have asked any friend to mention that, &#8216;the<br \/>\nlearned advocate is busy in another Court&#8217;.  The aforesaid submission<br \/>\nis also found to be far from the truth because the matter was called<br \/>\nout in the first half in first round, the learned advocate Mr. Shaikh<br \/>\nwas not present.  The matter was kept back.  It was then called out<br \/>\nin the second half.  In second half, on second call also he was not<br \/>\npresent.\n<\/p>\n<p>3.0\tHence,<br \/>\nno ground is made out for restoration.
