Bail Application No. 29420 of 2009\n               Satya Veer Vs. State of U.P.\nHon. Ravindra Singh, J.\n<\/pre>\n<p>     Heard Sri Jai Shanker Audichya and Sri J.P.S. Jadaun,<br \/>\nlearned counsel for the applicant, learned A.G.A. for the State of<br \/>\nU.P., Sri A. Kumar Singh, learned counsel for the complainant and<br \/>\nperused the record.\n<\/p>\n<p>     This bail application has been moved by the applicant Satya<br \/>\nVeer with a prayer that they may be released on bail in case crime<br \/>\nNo. 211 of 2009 under sections 302, 392, 411, 120-B IPC, P.S.<br \/>\nAkrabad, District Aligarh.\n<\/p>\n<p>     The facts, in brief, of this case are that the FIR of this case<br \/>\nhas been lodged by Marari Lal on 26.4.2009 at 10.10 P.M. in<br \/>\nrespect of the incident which had occurred on 26.4.2009 at about<br \/>\n7.30 P.M. The distance of the police station was about 14<br \/>\nkilometres from the alleged place of occurrence. The applicant is<br \/>\nnamed in the FIR, It is alleged that the deceased Dwarika Prasad<br \/>\nwas a dealer for a fair price shop, he had gone to Aligarh, at the<br \/>\ntime of the alleged occurrence he was returning to his village. The<br \/>\napplicant who was Pradhan of the village along with his associates<br \/>\ncommitted the murder of the deceased on the way. The alleged<br \/>\nincident was witnesses by Siya Ram Singh       and Jai Veer Singh,<br \/>\nabout one week prior the alleged incident           the threats was<br \/>\nextended by the applicant to the deceased. The deceased was<br \/>\nbrought to the hospital where he was declared dead. According to<br \/>\nthe post mortem examination report the deceased had sustained<br \/>\none fire arm wound of entry on the left side chest. The shot<br \/>\ndischarged by the applicant had hit the deceased.\n<\/p>\n<p>     It is contented by learned counsel for the applicant that the<br \/>\npresence of witnesses at the alleged place of occurrence was<br \/>\nhighly doubtful. According to the FIR itself, the first informant is<br \/>\nnot eye witness, the FIR was lodged only on the basis of the<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>doubt and suspicion and on account of the village partibandi. The<br \/>\nwitnesses are chance witnesses, there is no independent witness<br \/>\nof the locality to support the prosecution story. The first I.O. of<br \/>\nthis case came to the conclusion that applicant was falsely<br \/>\nimplicated but the second I.O. without having any other credible<br \/>\nevidence, chargesheet has been submitted against the applicant.<br \/>\nThe participation of the applicant in the commission of the alleged<br \/>\noffence is highly doubtful and nothing incriminating has been<br \/>\nrecovered from the possession of the applicant or at his pointing<br \/>\nout. The applicant is not having any criminal antecedent.\n<\/p>\n<p>     In reply of the above contention it is submitted by learned<br \/>\nA.G.A. and learned counsel for the complainant that the alleged<br \/>\nincident has been witnessed by the persons namely Jaiveer Singh<br \/>\nand others, according to the statement of Jaiveer Singh and Siya<br \/>\nRam the shot discharged by the applicant hit the deceased. The<br \/>\nprosecution story is corroborated by the medical evidence.<br \/>\nBecause according to the post mortem examination report the<br \/>\ndeceased has sustained gun shot wound of entry. The applicant<br \/>\nwas having strong motive to commit the alleged offence. In case<br \/>\nthe applicant is released on bail, he may temper with the<br \/>\nevidence.\n<\/p>\n<p>     Considering the submissions made by learned counsel for the<br \/>\napplicant, learned A.G.A. learned counsel for the complainant and<br \/>\nfrom the perusal of the record it appears that in the present case<br \/>\nthe applicant is named in the FIR, the allegation against him is<br \/>\nthat the shot discharge by him hit the deceased.
