By this petition, the petitioner seeks to challenge<\/p>\n<p>     the legality and validity of the order dated 15-7-2009<\/p>\n<p>     (Annexure &#8211; P\/1) passed by the State Transport Appellate<\/p>\n<p>     Tribunal, Chhattisgarh, Raipur, and the order dated 27-2-\n<\/p>\n<p>     2009 (Annexure &#8211; P\/7) passed by the office of the Regional<\/p>\n<p>     Transport Authority, Sarguja, Ambikapur.\n<\/p>\n<p>2.   According to the learned counsel appearing for the<br \/>\nrespondents, the period of the permit issued in favour of<br \/>\nthe petitioner has come to an end on 31-3-2010.  Thus, the<br \/>\nissue involved herein has become academic.\n<\/p>\n<p>3.   I have heard leaned counsel appearing for the<br \/>\nparties, perused the pleadings and the documents appended<br \/>\nthereto.\n<\/p>\n<p>4.   The dispute involved in the case on hand is that the<br \/>\npetitioner is plying the stage carriage on the basis of<br \/>\npermanent permit on the route Ambikapur to Jashpur via<br \/>\nManora, Aasta, Kusmi, Deepadih, Shankargarh, Bariyo &amp;<br \/>\nRajpur, as is evident from Annexures P\/2 &amp; P\/3.  The<br \/>\nrespondent No.4 has been granted permit vide Annexure P\/4<br \/>\non the same route i.e. Karoundha to Portenga via Kusmi,<br \/>\nAasta, Manora &amp; Jashpur.  There is clash of timing.  The<br \/>\npetitioner was granted permit on the said route for the<br \/>\nperiod from 01\/04\/2005 to 31\/03\/2010.  Permit of the<br \/>\npetitioner has come to an end on 31\/03\/2010.  Thus, this<br \/>\npetition has become infructuous.\n<\/p>\n<p>5.   The petitioner, by way of amendment, seeks to<br \/>\nchallenge the route granted to the petitioner on the basis<br \/>\nof subsequent permits granted to him.  This petition arise<br \/>\nfrom the order dated 15\/07\/2009 passed by the State<br \/>\nTransport Appellate Tribunal, the subsequent development<br \/>\ncannot be questioned in the present petition, which is<br \/>\nfiled under Article 227 of the Constitution of India<br \/>\nparticularly when the dispute has become infructuous.\n<\/p>\n<p>6.   It is well settled principle of law that if the<br \/>\nmatter has become infructuous on the facts of the case and<br \/>\nquestion remains to be decided for academic purpose, it is<br \/>\nnot necessary to examine the case, as observed by Supreme<br \/>\nCourt in several matters. <a href=\"\/doc\/761967\/\">(See Basheshar Nath v.<br \/>\nCommissioner of Income Tax, Delhi and Rajasthan and<\/a><br \/>\nanother1, <a href=\"\/doc\/1384660\/\">Dhartipakar Madan Lal Agrawal v. Rajiv Gandhi2,<br \/>\nSecretary, Ministry of Information &amp; Boradcasting, Govt.<br \/>\nof India and others<\/a> v. Cricket Association of Bengal and<br \/>\nothers3, <a href=\"\/doc\/1052896\/\">State of Manipur and others v. Chandam Manihar<br \/>\nSingh4, Amit Das<\/a> v. State of Bihar5 and Prakash Singh<br \/>\nBadal and another v. State of Punjab and others6).\n<\/p>\n<p>7.   Applying the well settled principle of law and for<br \/>\nthe reasons mentioned hereinabove, the petitioner is not<br \/>\nentitled to any relief.\n<\/p>\n<p>8.
