1.\t\tThe
\npresent petition is filed by two petitioners claiming the following
\nrelief:\n<\/p>\n
“…7(B).\tYour
\nLordships may be pleased to issue a writ of Mandamus or a writ in the
\nnature of Mandamus and\/or any other appropriate writ\/s, order\/s
\nand\/or direction\/s and be pleased to issue fresh directions by
\ndirecting the respondents to re-engage the petitioners in service, as
\npersons who are junior to the petitioners are still continued in
\nservice, in view of the order dated 15.05.2008 passed by this Hon’ble
\nCourt in Special Civil Application No.6111 of 2008 and 6112 of
\n2008…”\n<\/p>\n
1.1\t\tThe
\norder dated 15\/05\/2008 which is made the basis of this petition is
\nproduced as Annexure – G (page No.69). A plain reading of the
\norder makes it clear, which reads as under:\n<\/p>\n
‘3. \tIn
\nview of the directions issued by Labour Court, Surat (at this
\njuncture learned Advocate for the petitioner states that ‘Surat’ is
\nwrongly mentioned in place of ‘Rajkot’) in Reference No.6 of 1994 \/
\nReference No.7 of 1994 (New No.52 of 2007 and No.56 of 2007), where,
\nLabour Court has passed an award on 30th
\nJanuary 2008 while rejecting
\nthe relief of reinstatement and partly allowed the reference with a
\ndirection to respondent that  in future ,
\nif, the work, which was performed by petitioner, is available or
\narise, then, respondent shall have to issue before advertisement near
\nthe residence of petitioner and according to requirement of the work,
\non the basis of seniority, they should have to be provided work if
\nthe work is available.\n<\/p>\n
This Court has passed an order on 11th
\nApril 2008 which is quoted as under:(emphasis<\/p>\n
supplied).\n<\/p>\n
“1.\tHeard
\nlearned advocate Mr. H.S. Mulia appearing on behalf of petitioners.\n<\/p>\n
2.\tIssue
\nnotice to respondents returnable on 7th May 2008.\n<\/p>\n
3.\tMeanwhile,
\nit is directed to respondents to consider the case of both the
\npetitioners whose services were terminated earlier which is found to
\nbe illegal by Labour Court for re-engagement in the establishment, if
\nany junior employee is continue in service, on or before returnable
\ndate.\n<\/p>\n
4.\tIt
\nis further directed to respondents that if any vacancy is available
\nwith the respondents, then, respondent will consider the case of
\npetitioners for re-engagement in the establishment.\n<\/p>\n
5.\tIt
\nis further directed to respondents not to engage any new employee
\nagainst the vacant posts.\n<\/p>\n
6.\tDirect
\nservice is permitted.”\n<\/p>\n
4.\tIn
\nlight of the directions issued by this Court on 11th April
\n2008, it is directed to respondent that if, any vacancy is available
\nwith the respondent and whenever the work is available and whatever
\nthe nature of the work with respondents, then, respondents shall have
\nto consider the case of petitioner for re-engagement in establishment
\nand meanwhile, it is directed to respondent not to engage any new
\nemployee or fresh hand against the vacancy\/work till the petitioners
\nare provided the work by respondent as per directions issued by
\nLabour Court, Rajkot.\n<\/p>\n
5.\tIn
\nview of above observations and directions, rule is made absolute to
\nthat extent with no order as to costs”.\n<\/p>\n

2.\t\tThis
\norder is now made to be the basis for claiming the relief. The Court
\nis of the considered opinion that right from the beginning the
\npetitioners have been presenting their case before the learned Judge
\nof the Labour as well as before this Court ‘halfheartedly’. This is
\nobserved on the basis that the learned Advocate for the petitioners
\nstates that their case before the learned Judge of the Labour Court
\nwas that while retaining the juniors in service, the services of the
\npetitioners were terminated.  Now, if that was so, there was no
\nquestion of allowing the reference in terms as stated by the learned
\nAdvocate for the petitioners.  Thereafter, the aforesaid petitions
\nwere filed before this Court being SCA No.6111 and 6112 of 2008
\nwherein order was passed on 11\/04\/2008, which is quoted in judgment
\nand order dated 15\/05\/2008. In order dated 11\/04\/2008 certain
\ndirections were issued to the respondents and subsequently those
\npetitions are allowed by making Rule absolute by judgment and order
\ndated 15\/05\/2008. The direction which is issued on 11\/04\/2008 which
\nis subsequently made part of the judgment and order dated 15\/05\/2008
\nis only on the ground that,’…if, any vacancy
\nis available with the respondent and whenever the work is available
\nand whatever the nature of the work with respondents, then,
\nrespondents shall have to consider the
\ncase of petitioner for re-engagement in establishment and meanwhile,
\nit is directed to respondent not to engage any new employee or fresh
\nhand against the vacancy\/work till the petitioners are provided the
\nwork by respondent as per directions issued by Labour Court,
\nRajkot…”\n<\/p>\n
3.\t\tIn light of the aforesaid
\ndiscussion and the fact that right from the beginning petitioners
\nhave pleaded their case ‘halfheartedly’ and have felt satisfied \/
\ncontended with the aforesaid direction, no orders can be passed in
\nthis petition. This petition is in the nature of ‘execution petition’
\nfor the order \/ direction issued by this Court on 11\/04\/2008 and
\nreiterated in the judgment and order dated 15\/05\/2008 and the Court
\nrefuses to pass any order for implementation of the said directions
\nafter expiry of more than ‘three years’.\n<\/p>\n
3.1\t\tIn the result, the petition
\nstands dismissed.  But for the fact that petition is filed by the
\n‘workmen’, the Court would have dismissed this petition imposing
\nexemplary cost, however on a request made by learned Advocate
\nMr.Mehta for the petitioners taking a lenient view in the matter, the
\ncost is not imposed.\n<\/p>\n
