For the said<br \/>\n\tpurpose, application on behalf of the petitioners was moved<br \/>\n\trequesting the Court to permit the applicants of the said<br \/>\n\tapplication (Exh.89) to examine certain witnesses. By order dated<br \/>\n\t17.7.2007, the learned Court has rejected the said application. In<br \/>\n\tsubmission of Mr. Adhvaryu the said order is unjustified and<br \/>\n\terrornous.\n<\/p>\n<p>On<br \/>\n\tperusal of the order, it transpires that the learned Court has<br \/>\n\texamined the application properly and has taken into account that<br \/>\n\tthe proceedings before the Court in which application is preferred<br \/>\n\tare ?Sexecution proceedings?? and therefore, it has held that<br \/>\n\tthere was no justification or need for examining any witness or<br \/>\n\tproduction of documents during the execution proceedings. The<br \/>\n\tlearned Court has also recorded that the applicants were not able to<br \/>\n\tpoint out any provision or any authority under which such an<br \/>\n\tapplication can be maintained or entertained. The learned Court,<br \/>\n\tbeing of a view that in execution proceedings there is no scope of<br \/>\n\texamining witness or for production of documents \/ evidence and that<br \/>\n\tthere was neither justification nor any need to examine any witness<br \/>\n\tin the execution proceedings, rejected the application and rightly<br \/>\n\tso. Even otherwise, the petitioner ?  applicant has not made out,<br \/>\n\tas can be seen from perusal of the application, any case and\/or has<br \/>\n\tnot given any cogent reason or ground for such opportunity. The<br \/>\n\tpetitioner has failed to give any legally tenable and cogent<br \/>\n\tjustification in support of the prayer in its application. This<br \/>\n\tCourt, therefore, does not find any error or material irregularity<br \/>\n\tor illegality in the said order hence, present petition is<br \/>\n\tdismissed.
