JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\nfiled, with the following prayers:\n<\/p>\n<p>&#8220;A.\n<\/p>\n<p>\tAdmit and allow this petition;\n<\/p>\n<p>B.\tIssue<br \/>\na writ of mandamus or writ in the nature of mandamus or any other<br \/>\nappropriate writ, order or direction declaring the Advertisement<br \/>\nAnnexure-A dated 26.12.2010 and the corrigendum Annexure-I as<br \/>\nillegal,without authority of law and arbitrary and malafide and be<br \/>\npleased to quash the same and be further direct the respondents to<br \/>\ncontinue the petitioners;\n<\/p>\n<p>Or<br \/>\nin the alternative-\n<\/p>\n<p>Your<br \/>\nLordships may be pleased to issue a writ of mandamus or a writ in the<br \/>\nnature of mandamus or any other appropriate writ order or direction<br \/>\ndirecting the respondents, their agents and servants to continue the<br \/>\npetitioners and other Mats by treating them as regular Mats upto 28th<br \/>\nFebruary,2014 on the basis of the Resolution dated 15.9.2010<br \/>\nAnnexure-D and to give all other consequential benefits.\n<\/p>\n<p>C.\n<\/p>\n<p>Pending admission hearing and final disposal of this petition, direct<br \/>\nthe respondents, their agents and servants not to terminate the<br \/>\npetitioners and services of other similarly situated Mats;\n<\/p>\n<p>D.To<br \/>\npass such other and further orders necessary in the interest of<br \/>\njustice.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe very outset Mr.Bhushan B.Oza, learned advocate for the<br \/>\npetitioners states that the interest of justice  would be met if the<br \/>\npetitioners (two in number) are permitted to make a representation to<br \/>\nthe Commissioner, Rural Development (respondent No.3) herein, who may<br \/>\nbe directed to consider and decide the same, within a stipulated<br \/>\nperiod of  time.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioners, the following order is passed:\n<\/p>\n<p>\tThe<br \/>\npetitioners are  permitted to make a representation to respondent<br \/>\nNo.3 within a period of two weeks from today.
