Justice S.S.SATHEESACHANDRAN\n\n Dated :01\/02\/2010\n\n O R D E R\n             S.S.SATHEESACHANDRAN, J.\n                 -------------------------------\n             W.P.(C).NO.16882 OF 2006 ()\n               -----------------------------------\n        Dated this the 1st day of February, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>      The writ petition is filed seeking mainly the following<\/p>\n<p>reliefs:\n<\/p>\n<\/p>\n<blockquote><p>         i. to call for the records leading to Ext.P4<br \/>\n         and set aside the same.\n<\/p><\/blockquote>\n<blockquote><p>         ii. to issue a direction directing the court<br \/>\n         of the Munsiff-Magistrate, Pattambi not to<br \/>\n         evict the petitioners without determining<br \/>\n         the value of the improvements and without<br \/>\n         paying to them the value so determined.\n<\/p><\/blockquote>\n<blockquote><p>      2.   Ext.P4 order passed by the learned Munsiff-\n<\/p><\/blockquote>\n<p>Magistrate, Pattambi in the execution proceedings of a decree<\/p>\n<p>passed in a suit for partition and redemption, declining the<\/p>\n<p>request of the petitioners for assessment of the value of<\/p>\n<p>improvements and payment of compensation invoking the<\/p>\n<p>provisions  of   the   Kerala    Compensation      for Tenants<\/p>\n<p><span class=\"hidden_text\">WPC.16882\/06                   2<\/span><\/p>\n<p>Improvements Act, 1958, is challenged in the writ petition.<\/p>\n<p>      3. Petitioners are the legal heirs of the 3rd defendant in<\/p>\n<p>O.S.No.27 of 1978 on the file of the Munsiff-Magistrate Court,<\/p>\n<p>Pattambi. Admittedly, the 3rd defendant as one of the<\/p>\n<p>co-mortgagors redeemed the mortgage, and thereafter,<\/p>\n<p>plaintiffs, the other co-owners applied for partition and<\/p>\n<p>redemption instituting the above suit. Parties had gone up to<\/p>\n<p>the apex court over the disputes covered by the suit and by<\/p>\n<p>Ext.P2 judgment, the apex court directed for passing of a<\/p>\n<p>preliminary decree holding that the suit has been filed within<\/p>\n<p>the period of limitation and the redeeming mortgagor by<\/p>\n<p>subrogation    has  a   status  of   a   mortgagee     and  the<\/p>\n<p>non-redeeming co-mortgagors remitting the share of the<\/p>\n<p>mortgage price from them can get partition of the property.<\/p>\n<p>Admittedly, pursuant to Ext.P2 judgment, preliminary and<\/p>\n<p>final decrees have been passed in the suit. In execution of the<\/p>\n<p>decree, the present petitioners\/legal heirs of the 3rd defendant<\/p>\n<p>raised the plea of valuation of improvements invoking the<\/p>\n<p>provisions under the Compensation for Tenants Improvements<\/p>\n<p><span class=\"hidden_text\">WPC.16882\/06                    3<\/span><\/p>\n<p>Act, 1958. The decree holder filed objections to that claim and<\/p>\n<p>the learned Munsiff, after hearing both sides, declined the<\/p>\n<p>request made by the petitioners for valuation of improvements<\/p>\n<p>vide Ext.P4 order. Propriety and correctness of Ext.P4 order<\/p>\n<p>is challenged in the writ petition.\n<\/p>\n<\/p>\n<p>      I heard the learned counsel on both sides. Admittedly,<\/p>\n<p>before passing of the preliminary decree, no claim for value of<\/p>\n<p>improvements was canvassed nor assessed, and further, the<\/p>\n<p>share of the mortgage amount due from the plaintiffs had<\/p>\n<p>already been deposited by them.        So much so, there is<\/p>\n<p>cessation of the relationship of mortgagor-mortgagee between<\/p>\n<p>the parties. Then the only question is whether the<\/p>\n<p>petitioners\/legal heirs of the 3rd defendant are entitled to<\/p>\n<p>canvass and claim the benefit under the Compensation for<\/p>\n<p>Tenants Improvements Act, 1958. Section 5 (3) of the above<\/p>\n<p>Act makes it abundantly clear that the compensation for<\/p>\n<p>improvements made subsequent to the date up to which<\/p>\n<p>compensation for improvements has been adjudged in the<\/p>\n<p>decree and the re-valuation of an improvement can be<\/p>\n<p><span class=\"hidden_text\">WPC.16882\/06                      4<\/span><\/p>\n<p>canvassed by a tenant, provided there was a claim for<\/p>\n<p>improvement, its determination and awarding of compensation<\/p>\n<p>under the decree. In the present case, there was no claim nor<\/p>\n<p>any adjudication as to valuation of improvements before<\/p>\n<p>passing of the decree. That itself is sufficient to conclude that<\/p>\n<p>the present petitioners are incompetent to canvass any claim<\/p>\n<p>under the above Act.
