                    Heard learned counsel for the petitioner, the<\/p>\n
                      State and the opposite party no. 2.\n<\/p>\n
                                   Petitioner was earlier granted   provisional<\/p>\n
                      anticipatory bail     vide order dated 12.01.2011     and<\/p>\n
                      thereafter     matter has been heard several times and<\/p>\n
                      the husband – petitioner and the wife – opposite party<\/p>\n
                      no. 2 also appeared       in person before this    Court.<\/p>\n
                      However, the process of rapprochement could not<\/p>\n
                      bear any fruit.\n<\/p>\n
                                   It is submitted on behalf of the petitioner<\/p>\n
                      that he has already filed a matrimonial case before the
\n                   2<\/span><\/p>\n
Family Court, Buxar, bearing Matrimonial Case No.<\/p>\n
55 of 2009 for restitution of conjugal life and the<\/p>\n
matter is being proceeded therein. A petition was filed<\/p>\n
by opposite party no. 2 on 11.3.2011 under Section 24<\/p>\n
of the Hindu Marriage Act for grant of litigation cost<\/p>\n
and maintenance       during   the     pendency    of the<\/p>\n
aforesaid matrimonial case.\n<\/p>\n
          The aforesaid application has been disposed<\/p>\n
of on 14.6.2011 directing the petitioner          to make<\/p>\n
payment    of Rs. 3,000\/- as litigation cost       to the<\/p>\n
opposite party no. 2       and a sum of Rs. 1000\/- per<\/p>\n
month towards maintenance allowance from the date<\/p>\n
of the order.   It is submitted that the petitioner    is<\/p>\n
regularly paying the amount. The aforesaid fact has<\/p>\n
not been denied by the learned counsel for opposite<\/p>\n
party no. 2.\n<\/p>\n
          In view of the aforesaid order     and the fact<\/p>\n
that a matrimonial case for restitution of conjugal<\/p>\n
right was filed even before lodgment of the complaint<\/p>\n
case concerned,       as   submitted    on behalf of the<\/p>\n
petitioner and not controverted by the opposite party<\/p>\n
no. 2, the provisional anticipatory bail granted to the
\n                            3<\/span><\/p>\n
        petitioner vide order dated 12.01.2011 is hereby made<\/p>\n
        absolute.\n<\/p>\n
                    Accordingly,       this   application   stands<\/p>\n
        disposed of.\n<\/p>\n<\/p>\n
