3. The learned counsel for appellant would contend that<\/p>\n
the Commissioner was not justified in reckoning the diysaiimlity<\/p>\n
at 45%. Considering the nature of the injuries,<\/p>\n
earning capacity should have been cQn.s,idered’i’a’t–:’_a. l’1ig’h.e1~..v <\/p>\n
percentage. It is also the contention that t’hie”iwa’g.e’s <\/p>\n
by the Commissioner is on the low.e_i~..sidei’and’ tl’ieV_s’a;1’ne..calls * ii<\/p>\n
for enhancement.\n<\/p>\n
4. The learned coun.sel:~.  re’spoi;ntientwInsurance
\nCompany howeveiliifgi    quantum of
\ncompensation   It is contended
\nthat in factixthe capacity as assessed by the
\nCommissioner “it.:selfviis   side and therefore the
\nfur.ther  not arise. Even with regard to<\/p>\n
theawages, .it’\u00ab.is.iicontended that there was no satisfactory<\/p>\n
 evidence. ‘a;’Vailal3Ie”before the Commissioner and therefore the<\/p>\n
_iH_rno’nthly  reckoned at Rs.3,000\/– is appropriate.<\/p>\n

perusal of the award would indicate that the Commissionieriin<\/p>\n

claimant was working as a driver. Even though he_4..wa_si~.a<\/p>\n
driver of a light motor vehicle the fact that <\/p>\n
coolies the income was being reckoned….a.,t_'Rs;'l'O'0'\/ifli'ttler.i <\/p>\n
over the same in the year 2007 will h:ave1'_to"Vbei'ke'pt  :%.7'ie{n1<f<\/p>\n
and in that context considering ti1at~V..he is" a_ d1"_iVer,"'V.atie.ast a 'V '<\/p>\n
sum of RS.130\/- per day  be_reckon,ed.:\u00a7 If the
\nsame is done, the monthly si51n3V.of Rs.3,900\/ —<\/p>\n
If the 60% of  purpose of

\nCommissioner  of Rs.1,78,160\/–, the

7. ‘TheV___v’c1airnant is entitled to interest on the entire<\/p>\n

  award and at 12% thereafter. The said rate of<\/p>\n
 iin_ter*e”st shall be applicable to the enhanced portion of the<\/p>\n
