The claimant~appellant is seeking enhancement:<\/p>\n
compensation as against the sum awarded in WCA.”-SR  <\/p>\n
The claimants are the parents of the deceased .. &The_.decetased.:’was<\/p>\n
working as a cleaner in the vehicle.\n<\/p>\n
2. The only question that ariises’ for consideration in the
\npresent appeal is with regard {to   eerihancement of the
\ncompensation as against the C0II1II1iSSi0f1\u20ac1″-<\/p>\n
The Commissioner\ufb02Vii:as..V_awarde’d..___a.  of Rs.3,34,065\/-. While
\nconsidering theaincomei  theijcieceased, the Commissioner has
\nadverted  this   the matter while deciding issue Nos. 3, 4
\n  contention  claimants with regard to the income<\/p>\n
of the deceased..ha.s.heen noticed by the Commissioner. However,<\/p>\n
in the absence ‘documents, the Tribunal has taken the income at<\/p>\n
” iIV{s,_V1’0(A)\/- perday and thereafter has calculated the compensation.<\/p>\n
Tho’ugh_._i_n’ a normal circumstance the Commissioner would be<\/p>\n
“rV\u00a7’t1sVti\ufb01e\u00a7cl in reckoning the said income, in the instant case, it is<\/p>\n

noticed that the accident had occurred on 29\/ 07\/ 2006 and during<\/p>\n
the said period even in respect of coolies this court was reckoning<\/p>\n
a sum of Rs.100\/–. However, in the instant case <\/p>\n
claimant was Working as a cleaner it would bc:”ap~;irop’1″iate to <\/p>\n
reckon the daily wage Rs.110\/–. if that i:_p’s*d:on’e,_i the <\/p>\n
income would be a sum of Rs.3,300\/+.._V If sic-9.\/ulofp the:”sald.V_amiount <\/p>\n
is reckoned for the purpose of calculation  corhpuensativon and if
\nthe relevant factor as noticed   isiapplied, the
\ntotal compensation would he   –. Since the
\nCommissioner  aw-ardeldi \/ –, the claimants<\/p>\n
would be entitled toipthe.eiihan.ced.._compensation of Rs.33,406\/ –.<\/p>\n
3. Insofaraias   interest it is noticed that the
\nCommissiogneruhasxawarded interest on the compensation from 30
\nagf award. Since in the instant case, the claim<\/p>\n
was i11″1r’e’speC’t’ the interest payable is from 30 days after<\/p>\n
  date of ac._c’iden’t and to the said extent also the award calls for<\/p>\n
it ” ‘modification. “Hence, the respondent insurance Company shall pay<\/p>\n
i”._:’*the_enhanc’ed compensation of Rs.33,406\/– and while calculating<\/p>\n
 interest, the interest for the entire amount including the<\/p>\n
i<\/p>\n

amount awarded by the Commissioner as well as the enhanced<\/p>\n
portion shall be calculated from 30 days after the4″:date:i’.-def *<\/p>\n
accident and the amount shall be depositedpwithinieof  ii<\/p>\n
weeks from the date of receipt of a copy of ‘ord’er\u00a7” <\/p>\n
the entire amount shall be disburse’Cl.v.t0..the c1-fii1rI:9_1’1lt},, ‘  <\/p>\n

The Insurance.Co.rnpa.:nyi:’i’$?call*ingV__in iguestion the award
\npassed by the     2006 by the award
\ndtd. 29\/  has awarded the
\ncompensatio\ufb02 bi The contention of the Insurance
\nCompany while”‘a4ssa.iling   compensation in that manner
\niysvythat  disability.\u00e9ygyivireciizoned by the Commissioner is wholly<\/p>\n
u’njusti\ufb01_ed. contended that the nature of the injuries and also<\/p>\n
as stated._yby”the__D.oc’tor in his cross–examination, the injury can<\/p>\n
 only be iterrned  a temporary disablement. The Commissioner<\/p>\n
‘v\u00a5;~g”as_”‘ not justified in awarding compensation by taking the<\/p>\n
  percentages of the disability as done. It is further contended that in<\/p>\n
it any.\u00bbevent even a lesser percenktgge of the disability would arise in<\/p>\n

the instant case. It is therefore contended that the award is ___\u00a3iab\u00a3e<\/p>\n
to be set aside.\n<\/p>\n
2. The learned counsel for the respondent  <\/p>\n
that the Commissioner has noticed the efiidience of the jiboctorrand-V’<\/p>\n
aiso the documents rekating to the treatrrienit-._of <\/p>\n
that regard after appreciating the evidence, the.__Co.rnrnis’sio’neri has it<\/p>\n
arrived at the \ufb01nding of the fact,-rega’rdi’ng the ‘percentage of
\ndisabiiity and therefore no question.  fiaivv ‘for consideration<\/p>\n
in this appeai. It is th_e1’e__fore:’eontend.ed:;that3theiiaward passed by<\/p>\n
the Cornrnissioney.     interference.\n<\/p>\n
3. In  iight  contended by the learned
\ncounsei for theiiipartiesi,  of the award passed by the
\n iind._icate that, with regard to the grant of<\/p>\n
cor’ripenVsation_Vkeeping in View the nature of injuries has been<\/p>\n
 consideredrrby vttaepiciorrlmissioner while adverting to his decision on<\/p>\n
f\ufb02points No.iii3u,   Whiie taking note of the injuries suffered by<\/p>\n
;  ‘claimant, the Commissioner has referred to the evidence of Dr.<\/p>\n
‘;’_?ati1, who was examined before the Commissioner. In the<\/p>\n

overall view of the matter and noticing that the claimantqvvas<\/p>\n
working as a hamal, it would be appropriate to reci\u00ab;onii”thevVA<\/p>\n
disability at 20% in the facts and circumstances involvied ~<\/p>\n
case. if the disability is reckoned at 20% and the comp’e:n;satior1i.Visvs-_ <\/p>\n
recalculated adopting the other parameters ‘regard <\/p>\n
wages and the relevant factor. The’clairnanti’xvould   to
\nthe compensation of Rs. 70,74y_l\/– as the’  awarded
\nby the Commissioner. To the “Ehe’:ag;gard is modified
\nholding that the claimant is entitled to_reduc_evd:”.?;’0ii’npensation of
\nRs.70,741\/– with   “‘hy’LtheVCdmmissioner. The
\nreduced compensation”yywiih  j-shall be disbursed to the
\nclaimant and  ‘any, shall be refunded to the<\/p>\n
