No.2115 of 2011 has been filed for condonation<\/p>\n<p>                     of delay in filing this revision application.<\/p>\n<p>                           Heard the learned counsel for the petitioner and the<\/p>\n<p>                     learned counsel for the State.\n<\/p>\n<p>                           It is submitted that the petitioner was in custody in<\/p>\n<p>                     Sandesh P.S. Case No.92\/09 and the judgment in Cr.<\/p>\n<p>                     Appeal No.61\/2006 was delivered on 23.02.2010 when he<\/p>\n<p>                     was in custody and as such he could not get any<\/p>\n<p>                     information about the judgment and the order passed in the<\/p>\n<p>                     Criminal Appeal No.61\/2006. He was released from<\/p>\n<p>                     custody on 12.10.2010. He was arrested on 22.04.2011<\/p>\n<p>                     and since then he is in custody and time has also elapsed<\/p>\n<p>                     as he was in custody and thereafter he has managed to file<\/p>\n<p>                     this revision application.\n<\/p>\n<p>                           It appears that sufficient explanations have been<\/p>\n<p>                     given for condoning the delay in filing this revision<\/p>\n<p>                     application. The delay is condoned.\n<\/p>\n<p><span class=\"hidden_text\">                       2<\/span><\/p>\n<p>      I.A.No.2115\/2011 stands allowed.\n<\/p>\n<p>      The accused petitioner has preferred this revision<\/p>\n<p>application against the judgment and order dated<\/p>\n<p>23.02.2010 passed by the learned 3rd Additional Sessions<\/p>\n<p>Judge, F.T.C., Ara at Bhojpur in Cr. Appeal No.61\/2006<\/p>\n<p>by which the judgment and order dated 25.05.2006 passed<\/p>\n<p>by the learned trial court has been confirmed and the<\/p>\n<p>appeal has been rejected.\n<\/p>\n<p>      The learned counsel for the petitioner submits that<\/p>\n<p>this application can be disposed of at the time of<\/p>\n<p>admission itself. The learned counsel for the State has got<\/p>\n<p>no objection.\n<\/p>\n<p>      The prosecution case, in brief, is that on 9.01.1995<\/p>\n<p>the informant was feeding the cattle, the accused including<\/p>\n<p>the petitioner armed with various weapons came there and<\/p>\n<p>assaulted him. On Hulla, Ram Chhapit Yadav came there,<\/p>\n<p>he was also assaulted. At the time of escaping Jai Yadav<\/p>\n<p>(petitioner) took the gold chain of the informant. After<\/p>\n<p>investigation, charge-sheet was submitted against the<\/p>\n<p>accused. Cognizance was taken. After the trial, all the<\/p>\n<p>accused including the petitioner were held guilty and were<\/p>\n<p>convicted       and       sentenced   to   undergo   rigorous<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>imprisonment for three years under Section 325 of the<\/p>\n<p>I.P.C. and a fine of Rs.2000\/-each and in default of<\/p>\n<p>payment of fine, to undergo simple imprisonment for two<\/p>\n<p>months, to undergo simple imprisonment for one month<\/p>\n<p>under Section 341 of the I.P.C. and to undergo rigorous<\/p>\n<p>imprisonment for six months and a fine of Rs.500\/-each<\/p>\n<p>under Section 323 of the I.P.C. and in default of payment<\/p>\n<p>of fine, to undergo simple imprisonment for 15 days and<\/p>\n<p>all the sentences to run concurrently vide judgment and<\/p>\n<p>order dated 25.05.2006 passed in G.R. No.50\/95, Trial<\/p>\n<p>No.1432\/06. Convicts including the petitioner preferred<\/p>\n<p>Cr. Appeal No.61\/2006 against the aforesaid judgment and<\/p>\n<p>order. After hearing both the parties, appeal has been<\/p>\n<p>dismissed confirming the judgment and order passed by<\/p>\n<p>the learned trial court.\n<\/p>\n<p>       The learned counsel for the petitioner submits that<\/p>\n<p>the occurrence has taken place on 9.01.1995. More than 16<\/p>\n<p>years have passed. The petitioner has been suffering from<\/p>\n<p>mental agony. He has also been in custody for about seven<\/p>\n<p>months. There is land dispute between both the parties.<\/p>\n<p>The petitioner has no criminal antecedent.<\/p>\n<p>       The learned counsel for the State could not<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>              controvert the contention of the learned counsel for the<\/p>\n<p>              petitioner while opposing the prayer.\n<\/p>\n<p>                    After hearing the learned counsel for both the<\/p>\n<p>              parties and on perusal of the materials on the record, it<\/p>\n<p>              appears that the contention of the learned counsel for the<\/p>\n<p>              petitioner is correct. The occurrence has taken place on<\/p>\n<p>              9.01.1995. More than 16 years have passed. The petitioner<\/p>\n<p>              has been suffering from mental agony. He has also been in<\/p>\n<p>              custody for about 7 months.\n<\/p>\n<p>                    Considering the facts and circumstances, the<\/p>\n<p>              sentence requires modification. The sentence of the<\/p>\n<p>              petitioner is reduced to the period already undergone in<\/p>\n<p>              custody and a fine of Rs.3000\/-. The petitioner will deposit<\/p>\n<p>              the fine in the court below and file receipt thereof before<\/p>\n<p>              the learned trial court. In that case, the petitioner will be<\/p>\n<p>              released from custody, if not required in any other case. In<\/p>\n<p>              case the fine is realized, it will be given to the informant,<\/p>\n<p>              who is the main victim of the occurrence.\n<\/p>\n<p>                          With this modification in the sentence, this<\/p>\n<p>              revision application is dismissed.\n<\/p>\n<\/p>\n<pre>V.K.
