DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/11\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>Mr.Nirav<br \/>\n\tMajmudar, learned counsel for the applicants restricted this<br \/>\n\tapplication for applicant No.1 &#8211; Jayaben Kalidas Vasava and on<br \/>\n\tinstruction he does not press qua applicant No.2 &#8211; Jigneshbhai<br \/>\n\tKalidas Vasava at this stage. Permission as prayed for is granted.<br \/>\n\tAmendment to be carried out forthwith. Rule is restricted qua<br \/>\n\tapplicant No.1 only.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered at<br \/>\n\tC.R.No.I &#8211; 174 of 2010 with Gorwa Police Station, Vadodara for<br \/>\n\tthe offences punishable under Sections 307, 323, 504 and 114 etc. of<br \/>\n\tthe Indian Penal Code and under Section 135 of the Bombay Police<br \/>\n\tAct.\n<\/p>\n<p>Mr.Nirav<br \/>\n\tMajmudar, learned counsel appearing for the applicants submits that<br \/>\n\tthere is no overt act on the part of the applicant No.1 and a bamboo<br \/>\n\tstick was hit on the head of the deceased by one Kalidas. Besides a<br \/>\n\tcharge-sheet is filed and by imposing suitable conditions the<br \/>\n\tapplicant being a lady may be enlarged on bail.\n<\/p>\n<p>However,<br \/>\n\tMrs.Krina Calla, learned APP for the respondent &#8211; State<br \/>\n\tsubmits that the applicant had also participated in commission of<br \/>\n\tcrime and, therefore, she may not be enlarged on bail.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and considering overall facts<br \/>\n\tand circumstances of the case and the role attributed to the<br \/>\n\tapplicant being a lady and prima facie, it appears that she has not<br \/>\n\tplayed any overt act in commission of crime. At this stage, she<br \/>\n\tdeserves to be enlarged  on bail.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered at C.R.No.I &#8211; 174 of<br \/>\n\t2010 with Gorwa Police Station, Vadodara, on executing bond of<br \/>\n\tRs.5,000\/- [Rupees Five Thousand Only] with one surety of the like<br \/>\n\tamount to the satisfaction of the trial Court and subject to the<br \/>\n\tconditions that she shall;\n<\/p>\n<p>\t(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender her<br \/>\npassport, if any, to the lower Court within a week;\n<\/p>\n<p>(d)\tnot leave the State<br \/>\nof Gujarat without prior permission of the Sessions Judge concerned;\n<\/p>\n<p>(e)\tmark her presence at<br \/>\nthe concerned Police Station on the first Sunday of every month<br \/>\nbetween 10.00 a.m and 3.00 p.m for three months only;\n<\/p>\n<p>(f)\tfurnish the present<br \/>\naddress of residence to the Investigating Officer and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant only of she is not required<br \/>\n\tin connection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extend qua applicant No.1 only.<br \/>\n\tDirect Service is permitted.\n<\/p>\n<p>[<br \/>\nANANT S.
