Justice ANTONY DOMINIC\n\n Dated :17\/06\/2009\n\n O R D E R\n                  ANTONY DOMINIC,J.\n               ---------------------\n                W.P.(C).No.3220 OF 2004\n             ------------------------\n           Dated this the 17th day of June, 2009.\n\n                        JUDGMENT\n<\/pre>\n<p>     Petitioner was an Assistant Engineer in the service<\/p>\n<p>of the Board. On certain allegations of misconduct he was<\/p>\n<p>placed under suspension on 6.1.2003. He attained the<\/p>\n<p>age of superannuation on 31.3.2003. On that day he was<\/p>\n<p>reinstated and was allowed to retire from service.<\/p>\n<p>     2.   On 27.6.2003 Ext.P2 memo of charges was<\/p>\n<p>issued and the charges were following;\n<\/p>\n<blockquote><p>           &#8220;(1)    You have intentionally delayed the<br \/>\n           service connection in respect of one Sri.<br \/>\n           K.Kunhu      Muhammed,       Kallinkal  House,<br \/>\n           Chundale P.O, Vythiri with oblique motive and<br \/>\n           pecuniary interest.\n<\/p><\/blockquote>\n<blockquote><p>           (2)You     have    demanded     and   accepted<br \/>\n           Rs.2,000\/- as bribe from another consumer,<br \/>\n           Smt. Aysha, W\/o. Sri.kunhamu, Erichipalli<br \/>\n           House, Vythiri for effecting service connection<br \/>\n           to her newly constructed building.&#8221;<\/p><\/blockquote>\n<p>     3. He submitted Ext.P3 explanation and finally by<\/p>\n<p>Ext.P6, stating that on perusal of the reply submitted by<\/p>\n<p><span class=\"hidden_text\">WP(c).No.3220\/04                2<\/span><\/p>\n<p>the delinquent he has not put forth any point worth<\/p>\n<p>consideration, punishment of barring of his last drawn<\/p>\n<p>increment without cumulative effect for a period        of 6<\/p>\n<p>months was imposed. It was also ordered that the period of<\/p>\n<p>suspension be treated as suspension itself. It is challenging<\/p>\n<p>Ext.P6 that this writ petition is filed.<\/p>\n<p>      4.   Two contentions are raised. One is that in the<\/p>\n<p>absence of any allegation that any pecuniary loss was<\/p>\n<p>caused to the Board, continuance of the disciplinary action<\/p>\n<p>beyond retirement is impermissible in view of Rule 3 Part<\/p>\n<p>III KSR. A reading of Rule 3 shows that the Government<\/p>\n<p>have power to proceed against a retired person for ordering<\/p>\n<p>recovery from pension, the pecuniary loss caused to the<\/p>\n<p>Government, if the petitioner is ultimately found guilty of<\/p>\n<p>grave misconduct or negligence during the period of his<\/p>\n<p>service. In this case, the misconduct stated above did not<\/p>\n<p>make out a case coming within the scope of the said Rule.<\/p>\n<p><span class=\"hidden_text\">WP(c).No.3220\/04                3<\/span><\/p>\n<p>      5.   That apart    a reading of Ext.P6 shows that the<\/p>\n<p>disciplinary authority has not independently considered the<\/p>\n<p>explanation submitted by the delinquent. On the other had<\/p>\n<p>the order itself show that the disciplinary authority was<\/p>\n<p>acting at the dictates of the Chief Engineer by obeying his<\/p>\n<p>instruction to impose punishment on the petitioner. This<\/p>\n<p>contention of the petitioner also deserves acceptance. For<\/p>\n<p>the aforesaid reasons Ext.P6 order        is  quashed. It is<\/p>\n<p>directed that the disciplinary authority shall take a fresh<\/p>\n<p>decision about the manner in which the period of suspension<\/p>\n<p>of the petitioner is to be treated and on the basis of such<\/p>\n<p>decision s the respondent shall work out the pensionery<\/p>\n<p>benefits of the petitioner and allow the benefits on that<\/p>\n<p>basis.\n<\/p>\n<p>      Writ Petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                     (ANTONY DOMINIC)<br \/>\n                                            JUDGE<br \/>\nvi\/<\/p>\n<p><span class=\"hidden_text\">WP(c).No.3220\/04    4<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court V.K.
