Justice K.HEMA\n\n Dated :19\/08\/2010\n\n O R D E R\n                             K.HEMA, J.\n           ----------------------------------------------\n               Bail Application No.4957 of 2010\n           ----------------------------------------------\n                   Dated 19th August, 2010.\n\n                              O R D E R\n<\/pre>\n<p>           This petition is for bail.\n<\/p>\n<p>           2. The alleged offences are under Sections 379 and 34<\/p>\n<p>of the Indian Penal Code. According to prosecution, on 7.6.2010,<\/p>\n<p>between 10 and 10.45 a.m., petitioners, in furtherance of<\/p>\n<p>common intention, committed theft, by snatching away a gold<\/p>\n<p>chain and thali, weighing 4 sovereigns, from the neck of defacto<\/p>\n<p>complainant, in a temple premises.\n<\/p>\n<p>           3.  Petitioners were arrested on 11.6.2010. Learned<\/p>\n<p>counsel for petitioners submitted that petitioners are women and<\/p>\n<p>they are in custody for the past 71 days.<\/p>\n<p>           4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that bail was refused to petitioners, for the reasons<\/p>\n<p>stated in paragraph 5 of the order of the learned Sessions Judge<\/p>\n<p>(Annexure A1). Petitioners are involved in various other crimes of<\/p>\n<p>similar nature. The third accused is a convict also, for similar<\/p>\n<p>offences.   They have no proper or correct address.      It is also<\/p>\n<p>submitted that the charge is laid.\n<\/p>\n<p><span class=\"hidden_text\">BA NO. 4957\/10                     2<\/span><\/p>\n<p>            5. On hearing both sides and on going through the<\/p>\n<p>order of the learned Sessions Judge in the bail application, I am<\/p>\n<p>satisfied that there is every likelihood for the accused to abscond,<\/p>\n<p>if they are granted bail. It is also likely that they may repeat the<\/p>\n<p>offences.
