Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/12\/2009\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n           ------------------------------------------\n             Crl.M.C.NO.4146 OF 2009\n           ------------------------------------------\n           Dated 23rd          December 2009\n\n                         O R D E R\n<\/pre>\n<p>          Petitioners are the accused and<\/p>\n<p>second respondent, the de facto complainant<\/p>\n<p>in C.C.1202\/2007 on the file of Judicial<\/p>\n<p>First Class Magistrate-II, Attingal taken<\/p>\n<p>cognizance for the offences under Sections<\/p>\n<p>452, 294(b), 324 and 427 read with Section<\/p>\n<p>34 of Indian Penal Code. Petition is filed<\/p>\n<p>under  Section      482       of       Code         of Criminal<\/p>\n<p>Procedure   to         quash             the         proceedings<\/p>\n<p>contending that entire disputes with second<\/p>\n<p>respondent,   the de facto complainant                      who<\/p>\n<p>is also the injured, were settled amicably<\/p>\n<p>out of court and in view of the settlement,<\/p>\n<p>it is not in the interest of justice to<\/p>\n<p>continue the prosecution.\n<\/p>\n<p>       2. Second               respondent               appeared<\/p>\n<p><span class=\"hidden_text\">Crmc 4146\/09              2<\/span><\/p>\n<p>through a counsel and filed an affidavit<\/p>\n<p>stating that entire disputes were settled<\/p>\n<p>amicably       and   petitioners    and    second<\/p>\n<p>respondent are now living as friends and in<\/p>\n<p>such circumstances, he has no objection for<\/p>\n<p>quashing the proceedings.\n<\/p>\n<p>            3. Learned counsel appearing for the<\/p>\n<p>petitioners, second respondent and learned<\/p>\n<p>Public Prosecutor were heard.<\/p>\n<p>            4. Annexure-A final report shows that<\/p>\n<p>prosecution case is that, in furtherance of<\/p>\n<p>their       common  intention,   petitioners   on<\/p>\n<p>11\/10\/2007 at 12.15 p.m trespassed into the<\/p>\n<p>house where second respondent was residing<\/p>\n<p>and with a chopper        inflicted injury     on<\/p>\n<p>second respondent and thereby committed the<\/p>\n<p>offences.        Offences     alleged     against<\/p>\n<p>petitioners are purely personal in nature as<\/p>\n<p>against the second respondent.          Affidavit<\/p>\n<p>filed by the second respondent establishes<\/p>\n<p><span class=\"hidden_text\">Crmc 4146\/09               3<\/span><\/p>\n<p>that entire disputes were settled amicably.<\/p>\n<p>As          held by the Apex court in <a href=\"\/doc\/1442974\/\">Madan Mohan<\/p>\n<p>Abbot v. State of Punjab<\/a> (2008 (3) KLT 19<\/p>\n<p>(SC) when the offence against petitioners are<\/p>\n<p>purely personal in nature and there has been<\/p>\n<p>a complete        settlement of the disputes by<\/p>\n<p>second respondent, it is not in the interest<\/p>\n<p>of justice to continue the prosecution.
