Lakhani, learned advocate for the applicant states that in the<br \/>\nimpugned order, the learned Additional Sessions Judge has discussed<br \/>\nthe merits of the case and made observations on the merits.  He<br \/>\nsubmits that he seeks permission to withdraw the application,<br \/>\nhowever, the observations made by the learned Additional Sessions<br \/>\nJudge on the merits of the case may be set aside.\n<\/p>\n<p>2.\t\tOn<br \/>\nthe other hand, Ms. Shruti Pathak, learned advocate for the<br \/>\nrespondents states that the learned Judge has only recorded the<br \/>\narguments advanced by the learned advocates for the respective<br \/>\nparties and has not recorded any findings on the merits of the case<br \/>\nand as such, the request made by the learned advocate for the<br \/>\napplicant may not be acceded to.\n<\/p>\n<p>3.\t\tIn<br \/>\nthe light of the submissions advanced by the learned advocates for<br \/>\nthe respective parties, it appears that interest of justice would be<br \/>\nserved if it is observed that the observations made by the learned<br \/>\nAdditional Sessions Judge in the impugned order dated 5th<br \/>\nMarch, 2011 passed in Miscellaneous Criminal Applications No.64 &amp;<br \/>\n65 of 2011 whether in the form of recording of arguments of the<br \/>\nlearned advocates for the respective parties or on merits shall not,<br \/>\nin any manner, prejudice the case of either of the parties in any of<br \/>\nthe proceedings in respect of the FIR in question.  Subject to the<br \/>\naforesaid, the application is rejected as withdrawn.
