The present petitioner&#8217;s mini stall  was removed from the said<br \/>\n\tplace and assurance was given by Deputy Municipal Commissioner(South<br \/>\n\tZone) on 15-11-2008 that they will be allotted land admeasuring 5 to<br \/>\n\t6 Sq.mtrs. in new pushcart cluster in Kankaria Lake Front<br \/>\n\tDevelopment Project. Representation to this effect was made by the<br \/>\n\tpresent before the respondent but no decision is taken by the<br \/>\n\trespondent. It is submitted by Mr.Malkan that the petitioner will<br \/>\n\tmake a fresh representation in pursuance of the assurance given by<br \/>\n\tthe Deputy Municipal Commissioner before the respondent and if the<br \/>\n\tsaid representation is directed to be decided within a reasonable<br \/>\n\tperiod, the purpose of filing this petition would be served.\n<\/p>\n<p>In<br \/>\n\tview of the above, the petitioner is directed to make a fresh<br \/>\n\trepresentation in pursuance of the assurance given by the Deputy<br \/>\n\tMunicipal Commissioner on 15-11-2008 before the respondent within<br \/>\n\tfifteen days. As and when such a representation is made, the<br \/>\n\trespondent is directed to decide the same in accordance with law<br \/>\n\twithout being influenced by this order within a period of three<br \/>\n\tmonths.
