CIVIL WRIT PETITION NO.9445\/2008\n\n   Amarjeet Kaur v. State of Raj. &amp; ors\n\nDate of order:21st January, 2010\n\n         HON'BLE MR JUSICE AJAY RASTOGI\n\nMr H.S. Sidhu, for the petitioner\n\n\n\n      Counsel for the petitioner submits that\n\nthe controversy, which has been raised in\n\nthe    instant     petition,   is    covered      by    the\n\njudgment      of      this        Court     in       SBCWP\n\nNo.1899\/2005       decided   on    04th   August,      2006\n\nand has also been taken note of in SBCWP\n\nNo.530\/2009 decided on 02nd February, 2009;\n\nmaking following observation:\n\n          \"From reading of the proviso above,\n          it   is   clear  that  it   nowhere\n          restricts a widow or a divorced\n          lady from getting study leave if\n          she   do    not  acquire   required\n          qualification within a period of\n          three years. The grant of study\n          leave is not at all dependent to\n          the period prescribed for acquiring\n          the eligibility. As such, I do not\n          find any just and valid reason to\n                                   SBCWP No.9445\/2008\n                                               2 of 2\n\n         deny    study    leave     and    other\n         consequential    benefits      to   the\n         petitioners.\n             Accordingly, this petition for\n         writ is allowed. The respondents\n         are directed     to    sanction   study\n         leave to the petitioners and also\n         to       make    fixation      of   the\n         petitioners in      the   revised   pay\n         scales.
