SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/09\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner-Gujarat State Road Transport Corporation has prayed<br \/>\nfor an appropriate writ, order or direction quashing and setting<br \/>\naside the impugned order dated 16\/04\/2005 passed by the industrial<br \/>\ntribunal in Reference (I.T.) No. 355\/2002 by which the industrial<br \/>\ntribunal has partly allowed the reference and interfered with the<br \/>\norder of punishment imposed by the first appellate authority of<br \/>\nimposing punishment of stoppage of one increment with future effect<br \/>\nand substituting it to stoppage of one increment without future<br \/>\neffect.\n<\/p>\n<p>2.\tOn<br \/>\nconclusion of departmental inquiry against the petitioner for non<br \/>\nissuance of ticket, the disciplinary authority imposed punishment of<br \/>\nrecovering only Rs. 3\/- and the reviewing authority interfered with<br \/>\nthe said order of punishment and passed an order of imposing<br \/>\npunishment of stoppage of one increment with future effect, which<br \/>\nalso came to be interfered with by the Industrial Tribunal.  The<br \/>\nindustrial tribunal vide impugned judgement and order substituted it<br \/>\nto stoppage of one increment without future effect.\n<\/p>\n<p>3.\tHeard<br \/>\nMs. Sejal Mandaviya, learned advocate appearing on behalf of the<br \/>\npetitioner and Shri Mukesh Rathod, learned advocate appearing on<br \/>\nbehalf of the respondent and considering the impugned award, it<br \/>\nappears that the learned Industrial Tribunal has exercised the powers<br \/>\nunder Section 11(a) of the Industrial Disputes Act by substituting<br \/>\nthe order of punishment by the first appellate authority. Considering<br \/>\nthe fact that the charge and misconduct of non issuance of ticket<br \/>\ncame to be established and proved and when the reviewing authority<br \/>\nimposed the punishment of stoppage of one increment with future<br \/>\neffect, the Tribunal was not justified in interfering with the same<br \/>\nin exercise of powers under Section 11(a) of the Industrial Disputes<br \/>\nAct.\n<\/p>\n<p>4.\tUnder<br \/>\nthe circumstances, the impugned judgement and award passed by the<br \/>\nIndustrial Tribunal cannot be sustained and deserves to be quashed<br \/>\nand set aside.  In view of the above and for the reasons stated<br \/>\nhereinabove, the present petition succeeds and the order dated<br \/>\n16\/04\/2005 passed in Reference (I.T.) No. 355\/2002 is hereby quashed<br \/>\nand set aside.  Rule is made absolute to the aforesaid extent.
