SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/08\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tRULE.\n<\/p>\n<p>  Shri Nimish Kapadia, learned advocate waives service of notice<br \/>\nof rule on behalf of respondent no. 1, Ms. Sejal  Mandavia, learned<br \/>\nadvocate waives service of notice of rule on behalf of respondent no.<br \/>\n2 and Shri Pranav Dave, learned AGP waives service of notice of rule<br \/>\non behalf of respondents nos. 3 to 6.\n<\/p>\n<p>2.\tWith<br \/>\nthe consent of the learned advocates appearing on behalf of the<br \/>\nrespective parties and in the facts and circumstances of the case,<br \/>\nthe present petition is taken up for final hearing today.\n<\/p>\n<p>3.\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India the petitioners have prayed for an appropriate writ, order<br \/>\nor direction quashing and setting aside the impugned order dated<br \/>\n10\/07\/2009 passed by the learned Secretary (Appeals), Revenue<br \/>\nDepartment, State of Gujarat  in dismissing Revision Application No.<br \/>\n17\/2008 on the ground of delay and not condoning the delay in<br \/>\npreferring the Revision Application challenging the order passed by<br \/>\nthe Taluka Development Officer, Choryasi dated 19\/05\/2004.\n<\/p>\n<p>4.\tAfter<br \/>\nmaking elaborate submissions on merits of the case, the learned<br \/>\nadvocates appearing on behalf of the respondents have stated at the<br \/>\nbar that they have no objection if the delay caused in preferring the<br \/>\nRevision Application challenging the order passed by the Taluka<br \/>\nDevelopment Officer, Choryasi dated 19\/05\/2004 is condoned and the<br \/>\nRevision Application is decided and disposed of by the learned<br \/>\nSecretary (Appeals), Revenue Department, State of Gujarat on merits.<br \/>\nIn view of the above,  they do not invite any further reasoned order.\n<\/p>\n<p>5.\tUnder<br \/>\nthe circumstances, this Court is not further assigning any reasoned<br \/>\norder while allowing the present Special Civil Application and<br \/>\ncondoning the delay in preferring the Revision Application and<br \/>\ndirecting the learned revisional authority  to decide and dispose of<br \/>\nthe Revision Application in accordance with law on its own merits.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above and for the reasons stated hereinabove and the<br \/>\nbroad consensus between the learned advocates appearing on behalf of<br \/>\nthe respective parties, the present petition is allowed  and the<br \/>\nimpugned order  passed by the Secretary (Appeals), Revenue<br \/>\nDepartment, State of Gujarat dated 10\/7\/2009 in Revision Application<br \/>\nNo. 17\/2008 in not condoning the delay in preferring the Revision<br \/>\nApplication challenging the order of the Taluka Development Officer,<br \/>\nChoryasi dated 19\/07\/2004 is hereby quashed and set aside and the<br \/>\ndelay in preferring the Revision Application is hereby condoned.<br \/>\nNow, the learned Secretary (Appeals), Revenue Department, State of<br \/>\nGujarat to decide and dispose of Revision Application No. 17\/2008<br \/>\nafresh in accordance with law on its own merits.\n<\/p>\n<p>7.\tWith<br \/>\nthis, the present petition is allowed.  Rule is made absolute to the<br \/>\naforesaid extent.  There shall be no order as to cost.\n<\/p>\n<p> CIVIL<br \/>\nAPPLICATION NO. 9113\/2010 <\/p>\n<p>\tNow<br \/>\nso far as Civil Application No. 9113\/2010 filed by the West End<br \/>\nSports Club Limited, Director of the West End Sports Club Limited is<br \/>\nconcerned, Shri Vakil, learned advocate appearing on behalf of the<br \/>\napplicant  of the said application  has stated at the bar that<br \/>\nappropriate suitable observation may be made that this Court has not<br \/>\nexpressed anything on merits with respect to the authority of Shri<br \/>\nP.R.
