The respondent &#8211; original accused No.1 was ordered to<br \/>\n\tundergo RI for life and fine of Rs.10000\/- for the offence<br \/>\n\tpunishable under Section 302 of the IPC and RI for three years and<br \/>\n\tfine of Rs.5000\/- for the offence punishable under Section 201 of<br \/>\n\tthe IPC. Learned APP for the appellant submitted that considering<br \/>\n\tthe facts and circumstances of the case and the evidence on record,<br \/>\n\tthe trial Court should have awarded capital punishment to the<br \/>\n\trespondent &#8211; accused for the offence. He submitted that it is<br \/>\n\ttrue that considering the evidence on record, in the incident,<br \/>\n\trespondent &#8211; accused killed deceased Hemubhai and then threw<br \/>\n\tthe dead-body of the deceased in a well, so as to destroy the<br \/>\n\tevidence, but it is submitted that the fact that after killing the<br \/>\n\tdeceased, the respondent &#8211; accused threw the dead-body of the<br \/>\n\tdeceased in a well, and thereby attempted to destroy the evidence,<br \/>\n\twould turn this case within the category of rarest in rare case.<br \/>\n\tTherefore, it is submitted that the appeal deserves admission.\n<\/p>\n<p>\tWe<br \/>\n\thave perused the impugned judgment and order rendered by the trial<br \/>\n\tCourt. After recording the conviction of the respondent &#8211;<br \/>\n\taccused, the trial Court called upon both the sides to address the<br \/>\n\tCourt on the count of sentence. The trial Court, after considering<br \/>\n\tthe submissions advanced on behalf of both the sides, and more<br \/>\n\tparticularly, in paragraph 45 in the impugned judgment, clearly<br \/>\n\tobserved that the prosecution case cannot be said to be rarest in<br \/>\n\trare case and, ultimately, awarded the sentence of imprisonment for<br \/>\n\tlife. It is submitted on behalf of the appellant that after killing<br \/>\n\tthe deceased, the respondent &#8211; accused threw the dead-body in<br \/>\n\ta well, so as to destroy the evidence of the prosecution case and,<br \/>\n\ttherefore, the case falls within the category of rarest in rare<br \/>\n\tcase. There is no dispute that the accused was charged for the<br \/>\n\toffence of murder, punishable u\/s.302 of the IPC as well as he was<br \/>\n\talso charged for the offence causing disappearance of evidence<br \/>\n\tu\/s.201 of the IPC and, ultimately, the trial Court recorded the<br \/>\n\tconviction of the accused in connection with both the offences. To<br \/>\n\tput it differently, for causing disappearance of evidence, the<br \/>\n\taccused was appropriately punished by the trial Court. In that view<br \/>\n\tof the matter, we do not find any reason in the instant case to<br \/>\n\tinterfere with the order of sentence passed by the trial Court.
