4. The brief facts of the case are:\n<\/p>\n
On 8.1.2006 when the deceased was <\/p>\n
Qualis on the left side of the road and proceeding  K<\/p>\n
Hubli on P.B.Road near Shine way;  the<\/p>\n
driver of the KSRTC bus bpearinagx Registratiori , <\/p>\n
22\/F\/1364\/$1401 came in  and eneglilg:’ent~–;VVrnan’ner
\nand dashed against Toyota   Asadav-..res:’\u00a7u1t, he
\nsustained injuries and  -,.;g}uries on the
\nspot. Wife and   ‘petition before
\nthe Motor      Sagar seeking
\ncoInpen.sa’t’ion.A:’o”f  Tribunal awarded a<\/p>\n
sum of   4 “interest at 6% per annum.\n<\/p>\n

d  ‘depce’aCsed’Ain”i’ a roadvtradfiic accident and liability of Karnataka<\/p>\n
 Stated ‘ dvlfrajnsport Corporation, the only point that<\/p>\n
rernainsvfor consideration in this appeal is:
\n“Whether the quantum of<\/p>\n
compensation awarded by the Tribunal is just
\nand proper or does it call for enhancement ?”<\/p>\n

6. After hearing the learned Counsel for the parties<\/p>\n
and perusing the judgment and award of the ‘I’ribuna1,V’i~_a11j1<\/p>\n
of the View that the compensation awarded by A’  %<\/p>\n
is not just and proper, it is on the higher side andjtherefore; V’ ”<\/p>\n
it is deserved to be reduced.\n<\/p>\n
7. The deceased Sathyao;:ia”*xyas years
\nat the time of his deathgin  as”evideEnt from
\nP.M.Report ~– Ex.P4 and  where the
\ndate of birth is,Vm:ention;ed;’:’  are his wife
\nand two ‘~.of:’their’contention that the
\ndeceased   month by working as
\na driveff I  =Ci.aimant as PW.1 and have<\/p>\n
produced hishdsalaryaacertifieates at Ex.P.6, Ex.P.8 and R9.<\/p>\n
 _ t  to P.9x’r’e–veva1 the salary of the deceased at the time<\/p>\n
 “his retireinent will be Rs.16,391\/– . According to EXP8,<\/p>\n
the date of his death in the accident i.e..<\/p>\n
–g 8.1:200′(3: .is’Eis.8,287\/–. Salary which he was drawing at the<\/p>\n
it tiny; ofvvideath is shown in Ex.P8 and that has to be taken<\/p>\n
“‘ixjV1to”A’consideration. His gross salary was Rs.8,287\/~–, of<\/p>\n
 “which Rs. 100\/ — is deducted towards Profession Tax. So, his<\/p>\n
gross salary becomes Rs.8,187\/~. At the time of his death,<\/p>\n
he was aged about 51 years and nothing can be addedpptorhis<\/p>\n
salary towards future prospects. Multiplier applicable.fto_’__iii\u00a7:A’ <\/p>\n
age group is 11. The claimants are wife and t\\I.ro.V.1′:najor:Vson3. ‘<\/p>\n
Even if two major sons are ignoifed,:..one%4third’   <\/p>\n
deducted towards personal e2~:pensesf’._Accordingly; ioss of 0′<\/p>\n
dependency works out to Rs.7,20′;’\u00ab%iS\u20ac:\/ ~ ($211).<\/p>\n
8. In addition toRthaa’t’. zis entitled to a
\nsum of Rs. 10,0V0\u00a3.Jl\/-._  Rs. 10,000 \/ —<\/p>\n
towards   transportation of
\ndead body    love and affection.\n<\/p>\n
Thus, he is entitiefd-\u00bb”fo11o’wing compensation :-<\/p>\n
