Application No.909 of 2007, whereby<br \/>\n\tthe award passed by the Arbitral Tribunal is set aside..\n<\/p>\n<p>Mr.J.N. Desai, Manager (Secretary<br \/>\n\tand Legal), on behalf of the appellant is present as well as on<br \/>\n\tbehalf of the respondent, Mr.K.G.Sukhwani, learned Counsel appears.<br \/>\n\tBoth the sides delare before the Court that the matter is settled<br \/>\n\toutside the Court and as per the settlement, the amount of Rs.50 lac<br \/>\n\tas per the schedule of the payment is to be paid by the respondent<br \/>\n\tto the appellant.\n<\/p>\n<p>On behalf of the respondent, it<br \/>\n\thas been further undertaken that the cheques will be honoured on the<br \/>\n\tdue dates and shall not be bounced.  It has been further stated on<br \/>\n\tbehalf of the respondent that they will have no claim against the<br \/>\n\tappellant.\n<\/p>\n<p>The said settlement is placed on<br \/>\n\trecord.\n<\/p>\n<p>The aforesaid shows that the<br \/>\n\tparties have agreed to accept the amount namely; the appellant has<br \/>\n\tagreed to accept the amount of Rs.50 lac as full and final<br \/>\n\tsettlement against the award of the Arbitrator of Rs.92,57,534\/-<br \/>\n\twith interest at the rate of 10% per annum.  Mr.Sukhwani, learned<br \/>\n\tCounsel for the respondent and Mr.Desai for the appellant prayed<br \/>\n\tthat the appeal be disposed of in terms of the aforesaid settlement.\n<\/p>\n<p>\tMr.Sukhwani,<br \/>\n\tlearned Counsel has handed over all the cheques as per the schedule\n<\/p>\n<p>\t&#8211; Annexure-A and Mr.Desai on behalf of the appellant has<br \/>\n\tconfirmed the said position.\n<\/p>\n<p>Hence, the following orders:-\n<\/p>\n<p>(a)\tThe<br \/>\n\tjudgement and order passed by the trial Court shall stand modified<br \/>\n\tin terms of the settlement dated 30.6.2011, copy whereof is produced<br \/>\n\ttoday.
