{"id":39666,"date":"2011-09-22T00:00:00","date_gmt":"2011-09-21T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/rajo-mandal-vs-the-state-of-bihar-on-22-september-2011"},"modified":"2017-06-24T03:02:47","modified_gmt":"2017-06-23T21:32:47","slug":"rajo-mandal-vs-the-state-of-bihar-on-22-september-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/rajo-mandal-vs-the-state-of-bihar-on-22-september-2011","title":{"rendered":"Rajo Mandal vs The State Of Bihar on 22 September, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Rajo Mandal vs The State Of Bihar on 22 September, 2011<\/div>\n<pre>                    IN THE HIGH COURT OF JUDICATURE AT PATNA\n                        Criminal Miscellaneous No.18192 of 2011\n                                       Rajo Mandal\n                                           Versus\n                                    The State Of Bihar\n                              ----------------------------------\n<\/pre>\n<p>04.   22.09.2011             Heard learned counsel for the petitioner as<\/p>\n<p>                   well as learned Additional Public Prosecutor for the<\/p>\n<p>                   State.\n<\/p>\n<p>                             Learned   counsel   for   the   petitioner    is<\/p>\n<p>                   permitted to make necessary correction in the prayer<\/p>\n<p>                   portion of his petition during the course of the day.<\/p>\n<p>                             Petitioner being husband of the deceased<\/p>\n<p>                   is languishing in jail custody since 09.02.2011 in a<\/p>\n<p>                   case registered under Sections 302, 201\/34 of the<\/p>\n<p>                   I.P.C.\n<\/p>\n<p>                             Learned counsel for the petitioner submits<\/p>\n<p>                   that in course of investigation informant filed a<\/p>\n<p>                   petition before the court below mentioning this fact<\/p>\n<p>                   that present case had been lodged under some<\/p>\n<p>                   misconception and the similar statement has been<\/p>\n<p>                   made by the informant in course of his cross-<\/p>\n<p>                   examination in Sessions Trial No. 127 of 2011.<\/p>\n<p>                             Considering this aspect of the matter that<\/p>\n<p>                   the case has been registered under Section 302 of<\/p>\n<p>                   the I.P.C. and no specific overt act has been<\/p>\n<p>                   attributed against the petitioner and further more,<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>       the   informant   of   this case   has already   been<\/p>\n<p>       examined in course of trial, let the above named<\/p>\n<p>       petitioner be released on bail on furnishing bail<\/p>\n<p>       bonds of Rs.10,000 (Ten thousand) each with two<\/p>\n<p>       sureties of the like amount each to the satisfaction<\/p>\n<p>       of Additional Sessions Judge, F.T.V.-V, Supaul in<\/p>\n<p>       connection with S.Tr. No. 127 of 2011, arising out of<\/p>\n<p>       Chhatapur P.S.
