SHAH\n\t\t\n\t\n\n \n\nDate\n: 21\/01\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India<br \/>\nthe petitioner has prayed for an appropriate writ, order or direction<br \/>\nquashing and setting aside the impugned decision dated 12\/10\/2007<br \/>\nmade by the respondent-Corporation by further directing the<br \/>\nrespondent-Corporation to grant permission to the petitioner for<br \/>\ncommercial use, as per the revised plan submitted alongwith the<br \/>\nrepresentation dated 31\/08\/2007, in respect of part of the<br \/>\nland\/property forming part of Final Plot No. 315 of T.P. Scheme No.<br \/>\n1, Odhav, Ahmedabad.\n<\/p>\n<p>2.\tIt<br \/>\nappears that the land bearing Survey Nos. 36, 37, 38, 39, 40, 41 and<br \/>\n42 (Part) of village Odhav admeasuring 71,078 sq meters  and Survey<br \/>\nNos. 74, 75\/1, 75\/2, 79\/1, 79\/2 and 80 of village Nikol, District<br \/>\nAhmedabad was owned by one  Indian Electro Chemical Ltd. and was<br \/>\nmortgaged in favour of Union Bank of India.  It appears that the<br \/>\nproceedings were initiated by the Recovery Officer, Debts Recovery<br \/>\nTribunal, Ahmedabad  to recover the dues of Union Bank of India by<br \/>\nselling the aforesaid property, which was mortgaged in favour of<br \/>\nUnion Bank of India.  It is the case on behalf of the petitioner that<br \/>\nthe Recovery Officer invited bids and as the petitioner was found to<br \/>\nbe the highest bidder, the same came to be accepted and sale<br \/>\ncertificate in respect of the subject land came to be issued in<br \/>\nfavour of the petitioner.  In the meantime, land bearing Survey Nos.<br \/>\n36 to 42 were subjected to Town Planning Scheme and under the<br \/>\nfinalised Town Planning Scheme it was given Final Plot No. 315<br \/>\nsituated at Odhav.   It is the case on behalf of the petitioner that<br \/>\nFinal Plot No. 315 consisted of sub-plot Nos. 1 and 2  admeasuring<br \/>\n66,403 sq meters.  It appears that out of the total parcel of land,<br \/>\nland admeasuring 5082.04 sq meters was taken by the<br \/>\nrespondent-Corporation for the purpose of road, which is already<br \/>\nsurrendered to the respondent-Corporation and is constructed.  There<br \/>\nis some dispute with respect to payment of compensation for which<br \/>\nLetters Patent Appeal is pending.  It is the case on behalf of the<br \/>\npetitioner that after the aforesaid deduction, sub-plot  No. 1<br \/>\nadmeasures 49,219.32 sq meters whereas sub-plot No. 2 admeasures<br \/>\n11,996.44 sq meters.  According to the petitioner, the<br \/>\nrespondent-Corporation has approved the plan dated 09\/08\/2005 for<br \/>\n&#8216;A&#8217; Block consisting of 48 industrial sheds and permission dated<br \/>\n10\/08\/2005 was granted by the respondent-Corporation to  construct<br \/>\nfor &#8216;B&#8217; Block 43 industrial sheds  and vide permission dated<br \/>\n01\/02\/2006, respondent-Corporation granted permission to construct<br \/>\n&#8216;C&#8217; Block.  According to the petitioner, apropos the aforesaid<br \/>\npermissions, the petitioner constructed 48 industrial sheds forming<br \/>\npart of &#8216;A&#8217; Block and developed  industrial sheds forming part of &#8216;B&#8217;<br \/>\nBlock and &#8216;C&#8217; Block.  It is the case on behalf of the petitioner that<br \/>\nafter obtaining B.U. Permission, petitioner had sold in all 128<br \/>\nindustrial sheds  to different persons on different dates and<br \/>\npossession of the industrial sheds have also been handed over to the<br \/>\npurchasers.  It appears that thereafter the petitioner submitted<br \/>\nrevised plan for commercial use of ground floor and first floor with<br \/>\nrespect to 78 properties facing the road, which  is on<br \/>\nOdhav-Kapadvanj Highway.\n<\/p>\n<p>3.\tShri<br \/>\nNavin Pahwa, learned advocate appearing on behalf  of the petitioner<br \/>\nhas submitted that as there was dispute with respect to non payment<br \/>\nof municipal tax with respect to the persons occupied on the ground<br \/>\nfloor, the petitioner has restricted the prayer to grant development<br \/>\npermission with respect to the first floor only and, therefore, the<br \/>\nrespondent-Corporation is now required to consider the application of<br \/>\nthe petitioner for revised plan with respect to the first floor only.<br \/>\n It is the case on behalf of the petitioner that the<br \/>\nrespondent-Corporation is not processing the revised development plan<br \/>\nsubmitted by the petitioner with respect to the first floor and,<br \/>\ntherefore, the present Special Civil Application has been preferred<br \/>\nunder Article 226 of the Constitution of India.\n<\/p>\n<p>4.\tShri<br \/>\nNavin Pahwa, learned advocate appearing on behalf of the petitioner<br \/>\nhas submitted that as such the petitioner has nothing to do with the<br \/>\nindustrial sheds of Unit Nos. 1 to 78,  except Unit Nos. 9 and 67, as<br \/>\nthe petitioner has already sold those Units to various persons,<br \/>\nnames of whom have been referred to in the further affidavit at<br \/>\nAnnexure   A and for non-payment of municipal tax by them, the<br \/>\npetitioner shall not be penalised and\/or the respondent-Corporation<br \/>\ncannot refuse to consider the revised development plan submitted by<br \/>\nthe petitioner with respect to first floor.  Shri Navin Pahwa,<br \/>\nlearned advocate appearing on behalf of the petitioner has by way of<br \/>\naffidavit of Sunilbhai Dhirubhai Patel dated 20\/01\/2010 declared<br \/>\nbefore the Court and before the respondent-Corporation that the<br \/>\npetitioner does not claim any  ownership and\/or occupation and\/or<br \/>\npossession over Unit Nos. 1 to 78, the particulars of which are at<br \/>\nAnnexure   A to the petition, except Unit Nos. 9 and 67, and it<br \/>\nwill be open for the respondent-Corporation  to recover the tax from<br \/>\nthe said persons by selling and\/or by auctioning the said property<br \/>\nfor recovering the amount of municipal tax due and payable to the<br \/>\nrespondent-Corporation.  It is submitted by Shri Navin Pahwa, learned<br \/>\nadvocate appearing on behalf of the petitioner that so far as the<br \/>\nproperty owned and occupied by the petitioner is concerned, the<br \/>\npetitioner has already paid the amount of municipal tax and other<br \/>\ntaxes due and payable to the respondent-Corporation.  It is further<br \/>\nsubmitted by Shri Navin Pahwa, learned advocate appearing on behalf<br \/>\nof the petitioner that with respect to Unit Nos. 1 to 78 and\/or any<br \/>\nother Units until they are sold by proper documents, liability to pay<br \/>\nthe municipal tax\/other tax on the said Units is of the petitioner<br \/>\nand if there is any liability to pay the municipal tax\/other taxes on<br \/>\nthe said Units before the petitioner sold them, the petitioner shall<br \/>\nclear the same within a period of four weeks from today.\n<\/p>\n<p>5.\tShri<br \/>\nR.M. Chhaya, learned advocate appearing on behalf of the<br \/>\nrespondent-Corporation has submitted that in view of the further<br \/>\naffidavit filed by the petitioner today and the statement of Shri<br \/>\nNavin Pahwa, learned advocate appearing on behalf of the petitioner,<br \/>\nrecorded hereinabove, the respondent-Corporation cannot have any<br \/>\nobjection to consider the revised development plan submitted by the<br \/>\npetitioner with respect to the first floor of the property in<br \/>\nquestion and on clearing and\/or making the payment of the municipal<br \/>\ntax and other taxes due and payable by the petitioner as stated<br \/>\nhereinabove,  the respondent-Corporation shall process and consider<br \/>\nthe revised plan submitted by the petitioner for the first floor in<br \/>\naccordance with law on its own merits at the earliest.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above and the further affidavit filed by the petitioner<br \/>\ndated 20\/01\/2010 today, on payment of the entire municipal tax and<br \/>\nother taxes due and payable to the respondent-Corporation by the<br \/>\npetitioner for the property owned and occupied by it as on today and<br \/>\non payment of municipal taxes and other taxes due and payable to the<br \/>\nrespondent-Corporation with respect to other Units that is due and<br \/>\npayable till the petitioner was the owner of the industrial sheds, to<br \/>\nbe made within a period of four weeks from today,  the<br \/>\nrespondent-Corporation to process and consider the revised<br \/>\ndevelopment plan submitted by the petitioner for first floor in<br \/>\naccordance with law on its own merits within a period of eight weeks<br \/>\nfrom today and communicate the outcome of the same to the petitioner.<br \/>\n In view of the affidavit filed by the petitioner today, it will<br \/>\nalways be open for the respondent-Corporation to recover the amount<br \/>\nof municipal tax and\/or other taxes due and payable with respect to<br \/>\nindustrial sheds, the reference of which is made at Annexure   A to<br \/>\nthe affidavit filed today, except Unit Nos. 9 and 67, from the<br \/>\nconcerned persons (for the period after the petitioner has sold the<br \/>\nsaid industrial sheds) in accordance with law on its own merits.\n<\/p>\n<p>7.\tWith<br \/>\nthis, the present Special Civil Application is disposed of.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p> CIVIL<br \/>\nAPPLICATION No. 5537\/2009<\/p>\n<p>\tIn<br \/>\nview of the order passed in Special Civil Application No. 10404\/2008,<br \/>\nno order in the Civil Application.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Bileshwar vs State on 21 January, 2010 Author: M.R.
