MR BAGHEL\nfor MR HS MUNSHAW for Appellant(s) : 2, \nDELETED for Defendant(s) :\n1, \nMR AM DIVETIA for Defendant(s) : 1.2.1\n \n======================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 31\/01\/2011\n \n\nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tpresent Second Appeal has been filed under Section 100 of the Civil<br \/>\n\tProcedure Code by the appellant-original defendant challenging the<br \/>\n\tJudgment &amp; Order dated 30.04.1983 passed by the Learned District<br \/>\n\tJudge at Amreli in Regular Civil Appeal No.91 of 1981 confirming the<br \/>\n\tJudgment &amp; Decree dated 25.06.1981 passed by the Learned Civil<br \/>\n\tJudge (SD), Amreli in Regular Civil Suit No.328\/1977, wherein<br \/>\n\tfollowing substantial question of law are raised :-\n<\/p>\n<p>(a)\tWhether<br \/>\nin the facts and circumstances of the case, the court below committed<br \/>\nsubstantial error of law as well as of facts in decreeing the suit of<br \/>\nthe respondent plaintiff for declaration and injunction that the<br \/>\norder compulsorily retiring him from the service was illegal, null<br \/>\nand void?\n<\/p>\n<p>(b)\tWhether<br \/>\nin the facts and circumstances of the case, the court below erred in<br \/>\nholding that the respondent plaintiff was entitled to pay and<br \/>\nallowances during the period from 30th September 1977 to<br \/>\n10th Separately, 1979?\n<\/p>\n<p>(c)\tWhether<br \/>\nin the facts and circumstances of the case, the Appellate court erred<br \/>\nin holding that the respondent plaintiff is deemed to be in service<br \/>\nwith all the pecuniary benefits?\n<\/p>\n<p>(d)\tWhether<br \/>\nin the facts and circumstances of the case, can a Civil Court grant a<br \/>\ndecree and declaration that the birth date of the respondent<br \/>\nplaintiff was erroneously recorded in the Service Book?\n<\/p>\n<p>(e)\tWhether<br \/>\nin the facts and circumstances of the case, can the court come to the<br \/>\nconclusion regarding date of Birth even having no positive entry<br \/>\nregarding correct date of birth in the school leaving certificate ?\n<\/p>\n<p>(f)\tWhether<br \/>\nin the facts and circumstances of the case, lower court ought to have<br \/>\ndeclined to interfere on the ground f delay and acquiescence on the<br \/>\npart of the respondent plaintiff ?\n<\/p>\n<p>The<br \/>\n\tfacts of the case briefly stated are that Regular<br \/>\n\tCivil Suit No.328\/1977 was filed by the respondent-original<br \/>\n\tplaintiff, who was serving as Talati-cum-Mantri at Keriya-Chad under<br \/>\n\tAmreli District Panchayat. Suit was filed with regard to correction<br \/>\n\tin the date of birth. On the basis of evidence, the Suit was decreed<br \/>\n\tvide Judgment &amp; Decree dated 25.06.1981 passed by the Learned<br \/>\n\tCivil Judge (SD), Amreli with a declaration that the defendants to<br \/>\n\tpay all the benefits for a period from 30th<br \/>\n\tSeptember 1977 to 10th<br \/>\n\tSeparately, 1979. The said Judgment &amp; Decree was carried in<br \/>\n\tAppeal being Regular Civil Appeal No.91 of 1981 before the District<br \/>\n\tCourt and the Learned District Judge at Amreli vide Judgment &amp;<br \/>\n\tOrder dated 30.04.1983 dismissed the Appeal confirming<br \/>\n\tthe Judgment &amp; Decree of the trial Court. Therefore, the present<br \/>\n\tSecond Appeal has been filed posing the substantial questions of law<br \/>\n\tas stated above.\n<\/p>\n<p>\tIn<br \/>\n\tview of the order passed earlier dated 14.12.2010 by this Court, the<br \/>\n\tlearned counsel, Mr.Baghel for the applicant has placed on record a<br \/>\n\tcommunication dated 24.12.2010 from the Amreli District Panchayat<br \/>\n\tstating with regard to the fact that all the benefits have been<br \/>\n\tgiven to the deceased-plaintiff, who was employee of the Panchayat.<br \/>\n\tLearned counsel, Mr.Baghel, therefore, has stated that in view of<br \/>\n\tthe above fact, the present Seconal Appeal has become infructuous.\n<\/p>\n<p>Accordingly,<br \/>\n\tthe present Second Appeal stands disposed of as having become<br \/>\n\tinfructuous without any further elaboration.
