This is a claimanfs appeal for enhancement of<\/p>\n
compensation. j A E

2. I have heard Sri K. Ranjan Kumar, learned counsel
\nfor claimant and Sri. S. Srishaila. learned counsel for<\/p>\n
insurance company.\n<\/p>\n
3. The claim relates to compensation for damage
\ncaused to maxi~cab bearing N0.KA–l9\/7459, which belonged
\nto the claimant and insured with National insurance<\/p>\n
Company Ltd. [IV-Respondent before the Tribunal}.\n<\/p>\n
4. The vehicle of claimant had been insured under
\ncomprehensive policy. Therefore, claimant had submitted<\/p>\n
claim to NUS. National Insurance Company. The survey to<\/p>\n
assess damage was conducted by a surveyor. The total loss
\nwas evaluated at Rs.2,08,172\/– by the surveyor. The
\ninsurance company paid Rs.1,45,125\/– to the Canara Bank
\nwith which the maxi cab was hypothecated by claimant. The
\nclaimant has sought for the difference amount of
\nRs.55,000\/–. Therefore, the point for determination is<\/p>\n
whether the claimant is entitled to recover the difference<\/p>\n

amount of Rs.55,(}00\/– from M\/s. New India Assurance<\/p>\n
Company {Insurer of the bus\/ offending Vehicle}.\n<\/p>\n
5. Sri K. Ranjan Kumar, learned counsel for claimant
\nwould submit that claimant had not received damages in
\nterms of survey report. Therefore, the claim petition can be<\/p>\n
maintained for recovery of difference amount.\n<\/p>\n
6. The learned counsel for insurance company would
\njustify the impugned award. The learned counsel for the
\ninsurance company has relied on a decision reported in<\/p>\n
2005 ACJ 1332 (Harkhu Bai and others V\/s. Jiyaram and<\/p>\n
Others}, wherein a Division Bench of this court, has he1d:–\n<\/p>\n
“6. That leaves us with the claim in
\nlVl.V.C. No.3 of 1990. The Tribunal has
\nrejected the said claim on two grounds.
\nFirstly, because no negligence on the part
\nof the offending vehicle is proved and
\nsecondly, because the claimant, owner of
\nthe vehicle, has already received from the
\ninsurance company with which the
\nvehicle was insured an amount<\/p>\n
3<\/span><\/p>\n

representing the loss suffered by him.
\nWhile the finding on the first of the said
\nquestions has been reversed by us, we
\nsee no reason to interfere with the View
\ntaken by the Tribunal on the second
\nquestion. It is not in dispute that the
\nvehicle owned by the claimant in M.V.C.
\nNo.3 of l990 had suffered extensive
\ndamage on account of the collision but it
\nis also admitted that the Vehicle being
\ninsured with one of the other insurance
\ncompanies, the damage was assessed and
\npaid. The order passed by the Tribunal
\nfurther shows that the payment was<\/p>\n
received by the claimant in full and \ufb01nal<\/p>\n
settlement of his claim without any
\nreservation or demur. In the absence of
\nany material to show that the claim paid
\nby the other insurance company
\nrepresented a part only of the total
\ndamage, the Tribunal was justified in
\nrejecting the claim for any further
\npayment. We, therefore, see no merit in
\nthe appeal filed by the owner which shall<\/p>\n
have to be dismissed.”\n<\/p>\n
6 M.F.A.1311’7\/07(MV)<\/p>\n
7. In the case on hand, on 26.09.2003, IV-
\nRespondent, M\/ s. National Insurance Company has settied
\nthe claim for Rs.1,4~5.125\/– and credited the cheque for
\nRs.1,45,125\/- to the account of claimant in Canara Bank,
\nGandhinagar Branch, to which the claimant had
\nhypothecated his vehicle. On receipt of the letter of
\nsettlement dated 26.09.2003 from M\/s. National Insurance
\nCompany, the ciaimant had not made any protest. The
\nsettlement of claim was accepted without any protest or<\/p>\n
demur. Therefore. the claimant can not claim the difference<\/p>\n
amount from other insurance company namely M\/ s. New<\/p>\n
India Assurance Company Ltd. [IIwResp0ndent).\n<\/p>\n
8. The next point for determination is whether
\nclaimant is entitled to loss of earnings and interest paid by
\nclaimant to M \/ s. Canara Bank. At the outset, it is necessary<\/p>\n
to say that the claimant can not claim both interest and loss<\/p>\n
of earnings. %\\3 ‘ C ‘.E,=,M   <\/p>\n
7 M.F.A.13117\/OTIMV}<\/p>\n
The claimant was running a maxi cab (bearing No.KA–
\n19\/7459) and he was earning Rs.15,000\/– per month. After
\nthe accident he did not run the maxi cab. The loss of
\nearnings has to be assessed for number of days of non–usage
\nof vehicle. Considering the nature of damages, it would be
\nappropriate to award ioss of earnings for a period of two<\/p>\n
months @ Rs.12,000\/– pm.<\/p>\n
9. In View of the above, I pass the following\u00bb<\/p>\n
ORDER<\/p>\n
(i} The appeal is accepted in part.
\n{ii} The impugned award is set aside.\n<\/p>\n
{iii} The claimant is entitled to
\ncompensation of Rs.24,000\/– with
\ninterest at 6% p.a. from the date of
\npetition till the date of realisation
\nfrom H — Respondent [M\/s. New
