APPELLANT\n                           Versus\n                 THE STATE OF BIHAR.................................. RESPONDENT\n                          -----------\n<\/pre>\n<p>5   10-03-2011              Heard learned counsel for the appellant, learned<\/p>\n<p>                  counsel for the State and learned counsel for the informant.<\/p>\n<p>                            The appellant has renewed his prayer on the ground<\/p>\n<p>                  that he has remained in custody for about 2 years and 8<\/p>\n<p>                  months and there is no likelihood of appeal being heard in<\/p>\n<p>                  near future. It was pointed out that there was an observation<\/p>\n<p>                  that if the appeal is not heard within one year then the<\/p>\n<p>                  appellant may renew his prayer for bail and that one year has<\/p>\n<p>                  already elapsed since the date of such observation.<\/p>\n<p>                            Learned counsels appearing for the State and<\/p>\n<p>                  informant have submitted that the F.I.R. is on the basis of<\/p>\n<p>                  statement of the deceased himself in which this appellant<\/p>\n<p>                  allegedly gave one lathi blow on the head which, according to<\/p>\n<p>                  doctor, proved fatal.     In reply learned counsel for the<\/p>\n<p>                  appellant has challenged the claim of P.W.7 that he recorded<\/p>\n<p>                  the statement of the injured. It has further been submitted that<\/p>\n<p>                  the lathi blow was not repeated and hence there may not have<\/p>\n<p>                  been any intention to cause death.\n<\/p>\n<p><span class=\"hidden_text\">                            2<\/span><\/p>\n<p>                   In the facts and circumstances of the case, the<\/p>\n<p>         prayer for bail is again rejected for the present.   Let the<\/p>\n<p>         hearing of the appeal be expedited.
