The appellant-ESI Corporation is before <\/p>\n
assailing the order dated 19.10.2006  4_<\/p>\n
Application No.55\/04. The said :order.i’s”,a  ‘ j <\/p>\n
passed in four applications Whichiitwereil pending\u00bb.beforedthe<\/p>\n
Tribunal. Among four applications, the <\/p>\n
and the application  Storms damages
\nas ordered by the ESI Section 858 of
\nthe Employees   i.(_l_i_eTreinafter referred to
\nas ‘the    by the said order has
\nset   it holding that the<\/p>\n
damages’ are_not._payable:i1’i”the instant facts of the case.<\/p>\n
 \u00abtheclearned Counsel appearing for the<\/p>\n
 “per-u.sed the appeal papers.\n<\/p>\n
 3.-._”Th’:e appellant~ESI corporation had initially passed<\/p>\n
,i:an…_prde’r.. under Section 45A of the Act holding that the<\/p>\n
.0  it-espondenbcompany is liable to pay contribution in<\/p>\n
i.\n<\/p>\n
1′-\n<\/p>\n
respect of certain incentives granted to its employees<\/p>\n
inasmuch as it forms part of the wages. The saidlrissue<\/p>\n
was agitated by the respondent herein before <\/p>\n
which ultimately resulted in appeals bef_ore’iri.. <\/p>\n
MFA Nos. 1339\/ 1999 and 5628\/ 1998. in tthesaid  <\/p>\n
the issue was concluded holding that the <\/p>\n
liable to pay the  thereto, the
\ncontribution was requii’e:d.to.’pa’idv’:Aarid’according to the
\nappellant-Corporation  in payment of
\nthe ‘said     the damages were
\nlevied  In the instant case,
\nthe darnagels  14, 151 \/– was levied by order
\ndated 19.\u00e9.4:3p0o4l  ”  t<\/p>\n
V   Court, while considering the contentions<\/p>\n
  order, has referred to the aspect relating to<\/p>\n
lV._damageus”:. at para-16 of its order. In this regard, after<\/p>\n
 note of the rival contentions and also taking note of<\/p>\n
  contents of Regulation 31C of the Act has come to the<\/p>\n
t<\/p>\n

\npaid and in any event, when the matter was pending
\nconsideration before the ES} Court itself certain amounts
\nhad been paid and therefore, the question of<\/p>\n
damages would not arise.\n<\/p>\n
7. In the light of what has been contelnde’d’,,’_:in  i it <\/p>\n
view, the decision of the Hon’ble “Suprernell’C_o’t1rt \u00abA1-\u00a2rei4i4ed<\/p>\n
to by the learned Counsel for res.pondent:wo’uid not be<\/p>\n
applicable to the present facts—ofthle-.case’inasrnuch as in
\nthe instant case, the darnagest. by the appellant-<\/p>\n
corporation orgly\ufb01for  litigation between<\/p>\n
the parties  had ended in the earlier
\nappeals  in _ \/1999 and 5628\/1998.\n<\/p>\n
Therefore, what is to be noticed in the instant case is as to<\/p>\n
  respondents herein have deposited the<\/p>\n
Leon-t_rib’utien  had been determined within reasonable<\/p>\n
 _ time”—aft__er  disposal of the said appeals. The said<\/p>\n
 {asipect is “clear from the document available on record. In<\/p>\n
.’  this regard it is seen that the earlier appeals were disposed<\/p>\n
t<\/p>\n

of on 17.02.2003. The document at Ex.A7 which was
\nmarked before the E81 Court would indicate the details of<\/p>\n
the payments which were made. It is no dou\u00a7ot”.tra’e–.e:that<\/p>\n
certain amounts were paid during the perifdency: <\/p>\n
proceedings both before the ESI’\u00b0Co’urt_   <\/p>\n
before this Court. The very same d’Qcu.rnent.’would~ inmtiieatepp<\/p>\n
that after such payment, a  of: \/0′
\narising from the entire’:   after the
\ndisposal of the appeal.  is no dispute
\nthat the said”   the respondent<\/p>\n
company  indicate that there is<\/p>\n
delay oi7._one  ‘date of determination by this<\/p>\n
Court. aspect is kept in view, the ES}<\/p>\n
  not justified in setting aside the entire ciaim for<\/p>\n

 ‘C8.  come to the above conclusion, the issue<\/p>\n
0″~.4..’*for consideration is as to whether the appellant-<\/p>\n
  “‘-Corporation theinseives have passed an appropriate order<\/p>\n

under Section 858 of the Act. In this regard. as already<\/p>\n
noticed and also as extracted by the ES} Court itself, the<\/p>\n
regulation 31C of the ES} (General) <\/p>\n
would contemplate the rate at which the d&i’1u\u20ac1i\u00a7\u20acs’l-l.are tabbed <\/p>\n
ievied keeping in View the de1ayed,:4paiynli7entiy..  C<\/p>\n
a perusal of the order impuggnedllhefore <\/p>\n
would indicate that even  appe.llant~corp0ration
\nhave noticed all contentionsll-whiclh’wereputforth before the
\nauthority conc4f::f’I1__\u20acid,  the damages
\nhas been    llciearly indicated with
\nreference-Vto”‘the;:’p:erio.d  at which it is to be
\nlevied.1′:’fI’hereioVre’;’V-~  circumstance, it would have<\/p>\n
been appropriate  Court to set aside the said order<\/p>\n
 the.._.__matter to the original authority for<\/p>\n
 pl ifeconsivderation. However keeping in View the position that<\/p>\n
afte’rlheai’irig..e:the parties, at this stage, this Court has come<\/p>\n
to thev\ufb01conclusion that the E81 Court was not justified in<\/p>\n
 aside the order in its entirety and also since the<\/p>\n
  dates relating to payment is clear, and also noticing that<\/p>\n
t<\/p>\n
9:\n<\/p>\n
the respondent-wzornpany had paid certain amounts during<\/p>\n
the pendency of the initial dispute relating to contrihution<\/p>\n
when the matter was before the ESE Court anc;i”‘this.__’Cioi__iit,<\/p>\n
it would be appropriate for this Court\u00bb<\/p>\n
discretion and levy an appropriate   d<\/p>\n
be paid so as to draw the curtainsdwdon the _tiravJ,_n;.<\/p>\n
litigation.<\/p>\n
\n\n9. In  the demand is\nfor a sum pf    to the same, the\n<\/pre>\n
respond-en.t_sA”‘~\u00bbyhatie  a sum Rs.4,000\/-.
\nTherefore,’*  =b\u00a7aI’an<:e of the amount, the<\/p>\n
respondent:eompan'y_shall pay Rs.5,000\/–Which shall be<\/p>\n
 by theappellantcorporation as full and final<\/p>\n
  claim towards damages.\n<\/p>\n
*~  Hence with the above modi\ufb01cation of the order<\/p>\n
pf Court, the present appeal stands disposed of with a<\/p>\n
   direction to the respondent herein to pay the said sum of<\/p>\n
