Copy thereof is served to learned<br \/>\n\tadvocate Mr. Savjani, which is taken on record.\n<\/p>\n<p>Heard learned advocate Mr. RK<br \/>\n\tSavjani on behalf of petitioner, learned advocate Mr. Suren M. Shah<br \/>\n\tappearing for respondent no. 1.\n<\/p>\n<p>I have considered submissions made<br \/>\n\tby both learned advocates and also perused order passed by Trial<br \/>\n\tCourt in order 37 Rule 4 of Civil Procedure Code. The question<br \/>\n\tinvolved in present application would require detailed examination.<br \/>\n\tHence, Rule.  Interim relief in terms of para 13(B) till matter is<br \/>\n\tfinally decided by this Court.  Learned advocate Mr. Shah waives<br \/>\n\tservice of notice of Rule on behalf of respondent.\n<\/p>\n<p>It is made clear by this Court<br \/>\n\twhile passing interim order in favour of petitioner that BIFR<br \/>\n\tproceeding Misc. Application no. 577\/BC\/2010 is concluded on<br \/>\n\t13\/10\/2010. The following order has been passed by BIFR, which is as<br \/>\n\tunder:\n<\/p>\n<p>&#8220;1.\tThe<br \/>\n\tMisc. Application having registration No. 577\/BC\/2010 dated<br \/>\n\t5\/10\/2010 has been filed by Shri Dinesh Kumar, Advocate Bhagwati &amp;<br \/>\n\tAssociates of the company praying that this Hon&#8217;ble Board may be<br \/>\n\tpleased to:\n<\/p>\n<p>a)\tTo<br \/>\n\tdischarge the company from the purview of SICA as the networth of<br \/>\n\tthe company has turned positive.\n<\/p>\n<p>b)\tTo<br \/>\n\tpass any other order as your honour may deem appropriate.\n<\/p>\n<p>2.\tIn<br \/>\n\tthe hearing held today (13.10.2010), the representative of the<br \/>\n\tcompany submitted that this MA has been filed for discharge from the<br \/>\n\tpurview of SICA as the networth of the company has turned positive<br \/>\n\tamounting to Rs. 13.58 crore as per ABS for the Financial Year<br \/>\n\t2009-10.  It was further submitted that the company is working<br \/>\n\tsatisfactorily and earning profit from the last year.\n<\/p>\n<p>3.\tThe<br \/>\n\trepresentative of IDBI (MA) confirmed that the networth of the<br \/>\n\tcompany has turned positive and IDBI has no objection for<br \/>\n\tdischarging the company from the purview of SICA.\n<\/p>\n<p>4.\tAfter<br \/>\n\tconsidering the material on record and submissions made, the Bench<br \/>\n\tdischarged the company from the purview of SICA as the networth of<br \/>\n\tthe company has turned positive amounting to Rs. 13.58 crores.<br \/>\n\tSecured Creditors, Unsecured Creditors, if any, as well as,<br \/>\n\tGovernment Department are at liberty to recover the outstanding<br \/>\n\tdues, if any, from the company and the protection available under<br \/>\n\tSICA shall not be available to the company henceforth.\n<\/p>\n<p>Let<br \/>\n\ta copy of this order be circulated to all concerned.&#8221;\n<\/p>\n<p>In light of proceeding comes to an<br \/>\n\tend before BIFR, it is open for respondent to initiate<br \/>\n\taction\/proceeding against present petitioner for recovering an<br \/>\n\tamount in accordance with law.
