The said consent<br \/>\nterms reads as under:-\n<\/p>\n<p>&#8220;1.\tThe<br \/>\npresent respondent no. 1 is the original plaintiff in H.RP. Suit No.<br \/>\n2106 of 2008, filed before the Small Causes Court, Ahmedabad,   is<br \/>\none of the heirs and legal representatives of original tenant Kapurji<br \/>\nSadaji Parajpati and Kasturiben Kapurji Prajapati and is claiming the<br \/>\ntenancy rights of the original tenant in the suit property being<br \/>\nFinal Plot no. 44\/1 and Final Plot No. 44\/2 of T.P. Scheme No. 1<br \/>\n(Jamalpur), Ahmedabad belonging to the petitioner. The present Writ<br \/>\nPetition arises from the subordinate court proceedings being HRP Suit<br \/>\nNo. 2106 of 2008, of Small Causes Court No. 9, Ahmedabad.\n<\/p>\n<p>2.\tThe<br \/>\nparties to this writ petition have settled their disputes and<br \/>\ndifferences, and accounts pertaining to the suit property and rights<br \/>\nrelated thereto arising out of rent suit and original plaintiff &#8211;<br \/>\nrespondent no. 1 is withdrawing the disputes of the said suit<br \/>\nunconditionally. The other heirs of the original tenants have also<br \/>\nsinged the present consent terms in token of accepting this<br \/>\nsettlement unconditionally and in total waiver of their alleged<br \/>\nrights pertaining to the suit property, so as to avoid further<br \/>\ncomplications.\n<\/p>\n<p>3.\tThe<br \/>\nrespondent no. 1 &#8211; original plaintiff agree that he has no<br \/>\nright, title or interest in the suit property, left or any part or<br \/>\nparcel of land bearing F.P. No. 44\/1 and 44\/2 of T.P. Scheme No. 1<br \/>\n(Jamalpur) belonging to the petitioner, and agree that the writing<br \/>\nexecuted dated 07\/06\/2008 surrendering tenancy rights was agreed and<br \/>\nacted upon by and between the parties and no disputes or differences<br \/>\nremains in furtherance thereto nor shall have any right to file any<br \/>\nobjections, or claims or litigation in respect thereto.\n<\/p>\n<p>4.\tThe<br \/>\noriginal plaintiff hereby also withdraw all allegations and<br \/>\nimputations made in various litigations and before various<br \/>\nauthorities against the present petitioner &#8211; owner<br \/>\nand the respondent agree that their names be deleted as tenants from<br \/>\nmunicipal record and that he has no objection if the revised  plans<br \/>\nF.P. No. 44\/1 and 44\/2 of T.P. Scheme<br \/>\nNo. 1 (Jamalpur) is duly processed by the Ahmedabad Municipal<br \/>\nCorporation in favour of the present petitioner and all the ex-<br \/>\ntenants have given a writing  dated  04\/10\/2010 to the above effect<br \/>\nwhich shall be binding to the signatories of this consent terms.\n<\/p>\n<p>5.\tThe<br \/>\nH.R.P. Suit No. 2106\/2008 filed by the respondent no. 1 has been<br \/>\nstayed by order dated 15\/06\/2010\t However, on account of<br \/>\nmisunderstanding the trial court has passed an order for withdrawal<br \/>\nof the suit vide order 23\/11\/2010. The parties agree that the said<br \/>\norder Annexure &#8211; II be quashed and set aside and the trial<br \/>\ncourt be directed to pass decree in terms of the consent terms which<br \/>\nis produced at Annexure &#8211;
