(ORAL).\n<\/p>\n<p>            This writ petition has been filed with a prayer to quash<\/p>\n<p>order dated 01.03.20007 (P-5) vide which application of the petitioner,<\/p>\n<p>for registration of her marriage, was rejected.<\/p>\n<p>            When notice of motion was issued, following order was<\/p>\n<p>passed on 05.08.2009: &#8211;\n<\/p>\n<blockquote><p>             &#8220;Cites Baljit Kaur Boparai and another Vs. State of Punjab<\/p>\n<p>             and another, 2008(3) RCR (Civil) 109, to contend that after<\/p>\n<p>             marriage on attaining the age, as per provisions of the<\/p>\n<p>             Hindu Marriage Act, authorities are bound to register the<\/p>\n<p>             marriage.\n<\/p><\/blockquote>\n<blockquote><p>                   Notice of motion to the respondents for September 4,<\/p>\n<p>             2009. Dasti also.&#8221;<\/p><\/blockquote>\n<p>            As per the admitted facts, marriage of the petitioner was<\/p>\n<p>solemnized with Jasjit Singh Dhaliwal on 15.02.2007. At the time of<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No.5661 of 2009                                  -2-<\/span><\/p>\n<p>marriage, age of bridegroom was less than 21 years. Petitioner filed an<\/p>\n<p>application for registration of the marriage, which was rejected on the<\/p>\n<p>ground that Jasjit Singh Dhaliwal, husband of the petitioner, was not 21<\/p>\n<p>years of age when that application was moved.         When Jasjit Singh<\/p>\n<p>Dhaliwal completed 21 years of age, second application was filed,<\/p>\n<p>which was not received in the office of competent officer.<\/p>\n<p>            It is not in dispute that as on today Jasjit Singh Dhaliwal,<\/p>\n<p>husband of the petitioner, is more than the mandatory age required<\/p>\n<p>under the provisions of the Hindu Marriage Act, 1955. Under similar<\/p>\n<p>circumstances, a Division Bench of this Court in Baljit Kaur Boparai<\/p>\n<p>and another Vs. State of Punjab and another, 2008(3) RCR (Civil)<\/p>\n<p>109, where the marriage was not registered on account of condition of<\/p>\n<p>age, permitted the parties to move a fresh application for registration of<\/p>\n<p>marriage and it was observed as under: &#8211;\n<\/p>\n<blockquote><p>            &#8220;7.    After hearing learned counsel for the parties, we are<\/p>\n<p>            of the view that the modified prayer made by the learned<\/p>\n<p>            counsel for the petitioners deserves to be accepted. As<\/p>\n<p>            per Section 15 of the Special Marriage Act, 1954, any<\/p>\n<p>            marriage may be registered by a marriage officer provided<\/p>\n<p>            certain specified conditions are fulfilled. Section 15 of the<\/p>\n<p>            Special Marriage Act, 1954 lays down the following<\/p>\n<p>            conditions: &#8211;\n<\/p><\/blockquote>\n<blockquote><p>            &#8220;(a)   a ceremony of marriage has been performed<\/p>\n<p>            between the parties and they have been living together as<\/p>\n<p>            husband and wife ever since;\n<\/p><\/blockquote>\n<blockquote><p>            (b)    neither party has at the time of registration more than<\/p>\n<p>            one spouse living;\n<\/p><\/blockquote>\n<blockquote><p>            (c)    neither party is an idiot or a lunatic at the time of<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No.5661 of 2009                                  -3-<\/span><\/p>\n<p>          registration;\n<\/p><\/blockquote>\n<blockquote><p>          (d)   the parties have completed the age of twenty-one<\/p>\n<p>          years at the time of registration;\n<\/p><\/blockquote>\n<blockquote><p>          (e)   the parties are not within the degrees of prohibited<\/p>\n<p>          relationship:\n<\/p><\/blockquote>\n<blockquote><p>          Provided that in the case of a marriage celebrated before<\/p>\n<p>          the commencement of this Act, this condition shall be<\/p>\n<p>          subject to any law, custom or usage having the force of law<\/p>\n<p>          governing each of them which permits of a marriage<\/p>\n<p>          between the two; and<\/p>\n<\/blockquote>\n<blockquote><p>          (f)   the parties have been residing within the district of<\/p>\n<p>          the Marriage Officer for a period of not less than thirty days<\/p>\n<p>          immediately preceding the date on which the application is<\/p>\n<p>          made to him for registration of the marriage.&#8221; (Emphasis<\/p>\n<p>          added)<\/p>\n<\/blockquote>\n<blockquote><p>          8.    A perusal of the aforementioned conditions makes ti<\/p>\n<p>          obvious that the parties are required to have completed the<\/p>\n<p>          age of 21 years at the time of registration of their marriage.<\/p>\n<p>          Therefore, the prayer made by the petitioner that a new<\/p>\n<p>          application shall be filed on or after 27.05.2008 for<\/p>\n<p>          registration of petitioners&#8217; marriage, deserves to be<\/p>\n<p>          accepted. Accordingly, a direction deserves to be issued<\/p>\n<p>          to respondent No.2 to register the marriage of the<\/p>\n<p>          petitioners, if any such application is made on or after<\/p>\n<p>          27.05.2008.\n<\/p><\/blockquote>\n<blockquote><p>          9.    The aforementioned course has been adopted for<\/p>\n<p>          the reason that the compulsory registration of marriages is<\/p>\n<p>          to be encouraged albeit within the four corners of law.&#8221;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> Civil Writ Petition No.5661 of 2009                                  -4-<\/span><\/p>\n<p>            This Court is of the opinion that the present case is<\/p>\n<p>squarely covered by ratio of the judgment in Baljit Kaur Boparai&#8217;s<\/p>\n<p>case (supra).\n<\/p>\n<p>            In view of facts stated above, this writ petition is allowed.<\/p>\n<p>The petitioner is permitted to file fresh application, for registration of<\/p>\n<p>marriage, before respondent No.2.
