PUBLIC\nPROSECUTOR for Respondent(s) :\n1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 08\/09\/2011\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of present application, filed under Section 439 of the Code of<br \/>\n\tCriminal Procedure, 1973, the applicants prayed to release<br \/>\n\tthemselves on regular bail in connection with CR No.I-41 of 2011<br \/>\n\tregistered with Sihor Police Station, District Bhavnagar for the<br \/>\n\toffence punishable under Sections 143, 147, 148, 149, 323, 324, 307<br \/>\n\tand 34 of the Indian Penal Code and under Section 135 of the Bombay<br \/>\n\tPolice Act.\n<\/p>\n<p>Heard<br \/>\n\tMr.Bhunesh Upera, learned counsel for the applicants and Mr.Maulik<br \/>\n\tNanavati, learned Additional Public Prosecutor for respondent-State.\n<\/p>\n<p>Mr.Upera,<br \/>\n\tlearned counsel for the applicants, has contended that applicants<br \/>\n\thave not committed any crime as alleged and they have been falsely<br \/>\n\troped in by the complainant. He has also contended that prima-facie<br \/>\n\tcase is not made out against the applicants. He has also contended<br \/>\n\tthat the injured witness is already discharged from the hospital.\n<\/p>\n<p>Mr.Maulik<br \/>\n\tNanavati, learned Additional Public Prosecutor, has vehemently<br \/>\n\topposed the present application.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case and considering the nature<br \/>\n\tof allegations and role attributed to the applicants and now the<br \/>\n\tcharge-sheet is filed, without entering into the merits of the case,<br \/>\n\tprima facie, this Court is of the opinion that this is a fit case to<br \/>\n\texercise the discretion to enlarge the applicants on bail.\n<\/p>\n<p>Hence,<br \/>\n\tthe applicants are ordered to be released on bail in connection with<br \/>\n\tCR No.I-41 of 2011 registered with Sihor Police Station, District<br \/>\n\tBhavnagar, for the offence alleged against them in this application<br \/>\n\ton their executing a bond of Rs.10,000\/- (Rupees ten thousand only)<br \/>\n\teach with one solvent surety of the like amount to the satisfaction<br \/>\n\tof the trial Court and subject to the conditions that they shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of their liberty or \tabuse their liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution \twitnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the \tInvestigating Officer;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of\tthe prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the State of Gujarat without prior\tpermission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>f)\tnot<br \/>\nenter into the area of Bhavnagar district;\n<\/p>\n<p>g)\tfurnish<br \/>\nthe address of their residence to the\tInvestigating Officer\tand also<br \/>\nto the Court at the \ttime of execution of \tthe bond and shall<br \/>\nnot\tchange the residence without prior permission of\tthis Court;\n<\/p>\n<p>h)\tsurrender<br \/>\ntheir passport, if any, to the lower \tCourt within a week.\n<\/p>\n<p>If<br \/>\n\tthe breach of any of the above conditions is committed, the<br \/>\n\tconcerned Court will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.
