Sinha, Sr Advocate<br \/>\n                                       Dr Kumar Uday Pratap, Adv.\n<\/p>\n<p>                For the Respondents : M\/s Nadeem Seraj and<br \/>\n                                        Satish Kr Sinha, Advocates\n<\/p>\n<p>                                       &#8212;&#8212;&#8211;\n<\/p>\n<p>6   31.8.2010           Heard learned counsel for the petitioners and<\/p>\n<p>                learned counsel for the respondents.<\/p>\n<p>                        The only ground for refusing compassionate<\/p>\n<p>                appointment to the respondent was that in view of a<\/p>\n<p>                Railway Board&#8217;s circular dated 20.1.1992, the sons and<br \/>\n<span class=\"hidden_text\">                -2-<\/span><\/p>\n<p>daughters of second wife are not entitled for appointment<\/p>\n<p>on compassionate ground unless the second marriage has<\/p>\n<p>been contracted with permission of the Railway<\/p>\n<p>authorities.\n<\/p>\n<p>         Without specifically referring to the Railway<\/p>\n<p>Board&#8217;s aforesaid circular, a Division Bench of this<\/p>\n<p>Court in a case relating to Railways reported in 2002 (3)<\/p>\n<p>PLJR 146 (Union of India &amp; ors. v. Central<\/p>\n<p>Administrative Tribunals &amp; ors.) held that refusal of<\/p>\n<p>compassionate appointment when the first wife and the<\/p>\n<p>second wife had shared the retiral benefits and the first<\/p>\n<p>wife and nobody else has any objection to claim for<\/p>\n<p>compassionate appointment by a child born of second<\/p>\n<p>wife, was unjustified.\n<\/p>\n<p>         Subsequently, with due reference to the<\/p>\n<p>aforesaid Railway Board&#8217;s circular dated 2.1.1992 the<\/p>\n<p>Central Administrative Tribunal allowed the claim of<\/p>\n<p>compassionate appointment in favour of a child born<\/p>\n<p>from the second wife.      That matter came before a<\/p>\n<p>Division Bench of this Court in CWJC No.11259 of<\/p>\n<p>2007 <a href=\"\/doc\/286232\/\">(Union of India &amp; ors. v. Most. Ramsakhi Devi &amp;<\/a><br \/>\n<span class=\"hidden_text\">                    -3-<\/span><\/p>\n<p>     ors.). After recording the submissions on the basis of<\/p>\n<p>     Railway Board&#8217;s circular dated 2.1.1992, the Division<\/p>\n<p>     Bench quoted the views of the learned Tribunal and held<\/p>\n<p>     that there was not justifiable reason to take a different<\/p>\n<p>     view.    That view has been subsequently followed by<\/p>\n<p>     Division Benches of this Court in the case of (1) Union<\/p>\n<p>     of India &amp; ors. v. Central Administrative Tribunal &amp; ors.<\/p>\n<p>     CWJC No.13032 of 2006, decided on 9.7.2010 and (ii)<\/p>\n<p>     <a href=\"\/doc\/286232\/\">Union of India &amp; ors. V. Smt. Prem Lata Devi &amp;<\/a><\/p>\n<p>     another, CWJC No.12985 of 2008, decided on<\/p>\n<p>     15.1.2009.\n<\/p>\n<p>              In view of aforesaid consistent view of this<\/p>\n<p>     Court, we have no option but to dismiss this writ<\/p>\n<p>     petition. The writ petition is accordingly dismissed.
