Justice K.T.SANKARAN\n\n Dated :03\/11\/2009\n\n O R D E R\n                        K.T.SANKARAN, J.\n                   ---------------------------------------------\n                         B.A.No.6295 of 2009\n                   ---------------------------------------------\n             Dated this the 3rd day of November, 2009\n\n\n                                ORDER\n<\/pre>\n<p>      Apprehending arrest on an accusation of having committed<\/p>\n<p>non bailable offence in Crime No.714 of 2009 of Kasaragod Police<\/p>\n<p>Station, the petitioners have filed this application for anticipatory<\/p>\n<p>bail under Section 438 of the Code of Criminal Procedure.<\/p>\n<p>     2.    It is stated by the learned counsel for the petitioners<\/p>\n<p>that the defacto complainant filed a complaint before the Judicial<\/p>\n<p>Magistrate of the First Class-Kasaragod which was forwarded to<\/p>\n<p>the police for investigation under Section 156(3) of the Code of<\/p>\n<p>Criminal Procedure. Accordingly, the crime was registered for the<\/p>\n<p>offences under Sections 323, 341, 427, 498A and 506(ii) read with<\/p>\n<p>Section 149 IPC.\n<\/p>\n<p>     3.    The learned Public Prosecutor submitted that on<\/p>\n<p>investigation, it was found that accused Nos.3 to 5 have not<\/p>\n<p>committed any offence and their names were deleted from the<\/p>\n<p>array of accused.     It is also submitted by the learned Public<\/p>\n<p>Prosecutor that the offences alleged against the petitioners are<\/p>\n<p>under Sections 323, 324, 427 and 498A read with Section 34 of the<\/p>\n<p>Indian Penal Code.\n<\/p>\n<p><span class=\"hidden_text\">BA No.6295\/2009                     2<\/span><\/p>\n<p>      4.    Heard the learned counsel for the petitioners and the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p>      5.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioners.<\/p>\n<p>      There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioners, the officer in charge of the police station shall release<\/p>\n<p>them on bail on their executing bond for Rs.15,000\/- each with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the officer<\/p>\n<p>concerned, subject to the following conditions:<\/p>\n<p>a)    The petitioners shall appear before the investigating officer<br \/>\n      for interrogation as and when required;\n<\/p>\n<p>b)    The petitioners shall not try to influence the prosecution<br \/>\n      witnesses or tamper with the evidence;\n<\/p>\n<p>c)    The petitioners shall not commit any offence or indulge in any<br \/>\n      prejudicial activity while on bail;\n<\/p>\n<p>d)    In case of breach of any of the conditions mentioned above,<br \/>\n      the bail shall be liable to be cancelled.\n<\/p>\n<p>\n      The Bail Application is allowed to the extent indicated above.<\/p>\n<p>                                                 K.T.SANKARAN,<br \/>\n                                                       JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Latheef Ahammed Haji vs State Of Kerala Rep.By Inspector &#8230; on 3 November, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6295 of 2009() 1.
