DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/11\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with First Information Report registered at<br \/>\nC.R.No. I-350 of 2010 with &#8220;A&#8221; Division Police Station,<br \/>\nDistrict : Rajkot, for the offences punishable under Sections 457,<br \/>\n454, 380 and 114 etc. of the Indian Penal Code.\n<\/p>\n<p>2.\tMr.P.\n<\/p>\n<p>Y. Jasani, learned counsel for the applicants submits that the<br \/>\napplicants have no antecedent and allegations against them are based<br \/>\non conjuncture  and surmises and the applicants are ready and willing<br \/>\nto abide by the conditions that may be imposed by this Court.\n<\/p>\n<p>3.\tMr.L.\n<\/p>\n<p>R. Pujari, learned APP for the respondent &#8211; State submits that<br \/>\nthe applicants are involved in serious offence and, therefore, he may<br \/>\nnot be enlarged on bail.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsel for the parties and considering the record of<br \/>\nthe case prima facie, nature of the allegations viz-a-viz role<br \/>\nattributed to the applicant and cause of justice will be served by<br \/>\nimposing suitable conditions while enlarging the applicants on  bail.\n<\/p>\n<p>5.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicants are ordered to be released on bail in connection<br \/>\nwith First Information Report registered \tat C.R.No. C.R.No. I-350 of<br \/>\n2010 with &#8220;A&#8221; Division Police Station, District : Rajkot,<br \/>\non executing bond of Rs.5,000\/- [Rupees Five Thousand Only] each with<br \/>\none surety of the like amount to the satisfaction of the trial Court<br \/>\nand subject to the conditions that they shall;\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender<br \/>\ntheir passports, if any, to the lower court within a \tweek;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the \tSessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tmark<br \/>\ntheir presence at the concerned Police Station on the \tfirst \tSunday<br \/>\nof every month between 10.00 a.m. and 3.00 \tp.m for three months<br \/>\nonly;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present addresses of residences to the I.O. and \talso to the<br \/>\nCourt at the time of execution of the bond and shall \tnot change the<br \/>\nresidence without prior permission of this \tCourt;\n<\/p>\n<p>6.\tThe<br \/>\nAuthorities will release the applicants only if they are  not<br \/>\nrequired in connection with any other offence for the time being.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.
