SHAH\n\t\t\n\t\n\n \n\nDate\n: 25\/01\/2011 \n\n \n\nORAL ORDER<\/pre>\n<p>RULE.\n<\/p>\n<p>\tMs.VS Pathak, learned A.G.P.  waives the service of notice of rule<br \/>\n\ton  behalf of the respondent No.1 and Mr.HS Munshaw, , learned<br \/>\n\tadvocate appearing on behalf of the respondent No.3 &#8211; A.M.C..\n<\/p>\n<p>Present<br \/>\n\tapplication has been preferred by the applicant &#8211; original<br \/>\n\tclaimant, permitting her  to prosecute the First Appeal as an<br \/>\n\tindigent person.\n<\/p>\n<p>Having<br \/>\n\theard Mr.Hiren Modi, learned advocate appearing on behalf of the<br \/>\n\tapplicant, Ms.VS Pathak, learned A.G.P. appearing for the respondent<br \/>\n\tNo.1  and Mr.HS Munshaw,  learned advocate appearing for respondent<br \/>\n\tNo.3 &#8211; A.M.C., and considering the averments made in the<br \/>\n\tapplication  and \u00a0considering the fact that the applicant &#8211;<br \/>\n\toriginal claimant was permitted to prosecute the claim petition as<br \/>\n\tindigent person and the said claim petition has been dismissed and<br \/>\n\tthere  is not change in circumstances,  present application is<br \/>\n\tallowed. The applicant is permitted to prosecute the First Appeal as<br \/>\n\tan indigent person. Rule is made absolute accordingly.
