The petitioner has, therefore applied for<br \/>\ncompassionate appointment, which came to be rejected on the ground<br \/>\nthat the family is getting Rs. 2630\/- towards pension and, therefore,<br \/>\nhe is not entitled to compassionate appointment. Hence, the<br \/>\npetitioner has preferred the present petition.\n<\/p>\n<p>3.0\tHeard<br \/>\nthe learned advocates for the respective parties and perusal the<br \/>\nrelevant documents. It appears that the application has been rejected<br \/>\non the ground that the family has pension income which is not<br \/>\ndisputed. Apart from that the purpose of providing appointment on<br \/>\ncompassionate ground is to mitigate the hardship due to death fo the<br \/>\nbreadwinner in the family and such appointment should therefore, be<br \/>\nprovided immediately to redeem the family in distress. The father of<br \/>\nthe petitioner has expired in the year 1995 and the family survived<br \/>\nin all these years. Further, there was no effort on the part of the<br \/>\npetitioner to hear the present petition  at any point of time. In<br \/>\ncase of <a href=\"\/doc\/1830553\/\">State of J &amp; K V. Sajad Ahmed Mir,<\/a> reported<br \/>\nin (2006) 5 SCC 766, the Apex Court has held as under:\n<\/p>\n<p>\t 11&#8230;.\n<\/p>\n<p>Normally, an employment in the Government or\tother public sectors<br \/>\nshould be open to all eligible\tcandidates who can come forward to<br \/>\napply and compete\twith each other. It is in consonance with Article<br \/>\n14 of the \tConstitution. On the basis of competitive merits, an<br \/>\n\tappointment should be made to public office. This\tgeneral rule<br \/>\nshould not be departed from except where\tcompelling circumstances<br \/>\ndemand, such as, death of the \tsole breadwinner and likelihood of the<br \/>\nfamily suffering \tbecause of the setback. Once it is proved that in<br \/>\nspite of\tthe death of the breadwinner, the family survived and<br \/>\n\tsubstantial period is over, there is no necessity to say\t&#8216;goodbye&#8217;<br \/>\nto the normal rule of appointment and to   \tshow favour to one at the<br \/>\ncost if the interests of several \tof several others ignoring the<br \/>\nmandate of Article 14 of \tthe Constitution.\n<\/p>\n<p>4.0\tThe<br \/>\nabove view has been reiterated by the Apex Court in the case of<br \/>\n<a href=\"\/doc\/195133\/\">Eastern Coalfields Limited vs. Anil Badyakar and others<\/a><br \/>\nreported in (2009) 13 SCC 112.\n<\/p>\n<p>5.0\tIn<br \/>\nthe premises aforesaid, I do not find any merits in the petition. The<br \/>\nsame is accordingly rejected.
