AKASH CHATURVEDI, ADVOCATE<br \/>\n                                   ********<\/p>\n<p>12   28.03.2011            Heard learned counsels for the petitioner, the<\/p>\n<p>                  State and the informant.\n<\/p>\n<p>                           The offence alleged is under sections 498A, 406<\/p>\n<p>                  &amp; 34 of the Indian Penal Code read with sections 3 &amp; 4 of<\/p>\n<p>                  the Dowry Prohibition Act.\n<\/p>\n<p>                           This is second attempt for grant of anticipatory<\/p>\n<p>                  bail. The first application was considered by this Court on<\/p>\n<p>                  merits and upon considering the nature of allegations and<\/p>\n<p>                  the materials declined to accede to the request of the<\/p>\n<p>                  petitioner. The application was accordingly dismissed by<\/p>\n<p>                  order dated 24th July, 2008 as contained in Annexure-B to<\/p>\n<p>                  the counter affidavit filed on behalf of the opposite party<\/p>\n<p>                  no.2. Petitioner thereafter approached the Apex Court vide<\/p>\n<p>                  Special Leave to Appeal (Crl.) No. 5983 of 2008 against the<\/p>\n<p>                  dismissal of his anticipatory bail application by this Court.<\/p>\n<p>                  The Apex Court declined to accept the prayer of the<\/p>\n<p>                  petitioner for protection in terms of Section 438 of the<\/p>\n<p>                  Code of Criminal Procedure. The special leave petition was<\/p>\n<p>                  accordingly dismissed. The Apex Court, however, observed<\/p>\n<p>                  that if petitioner surrenders before the concerned Court<br \/>\n and moves an application for bail the same would be<\/p>\n<p>disposed of on the day the petitioner appears provided an<\/p>\n<p>intimation of moving the application for bail is given to the<\/p>\n<p>prosecuting agency. Petitioner did not surrender in view of<\/p>\n<p>the observations of the Apex Court. It is, however,<\/p>\n<p>submitted that the petitioner again moved for grant of<\/p>\n<p>anticipatory   bail   twice   before   the   Sessions   Judge<\/p>\n<p>apprehending his arrest on account of issuance of warrant<\/p>\n<p>of arrest. The bail application of the petitioner was second<\/p>\n<p>time rejected by the Sessions Judge on 01.08.2009 as per<\/p>\n<p>the Anticipatory Bail Petition No. 3613 of 2009 vide<\/p>\n<p>Annexure-H to the counter affidavit. Petitioner has now<\/p>\n<p>filed this second anticipatory bail application.<\/p>\n<p>          It is submitted that in view of the materials<\/p>\n<p>collected during investigation no substantial material has<\/p>\n<p>been collected against him, and as such, his application<\/p>\n<p>for anticipatory bail should be allowed.<\/p>\n<p>          Learned counsel for the opposite party no.2 on<\/p>\n<p>the other hand opposes the prayer for bail and submits<\/p>\n<p>that this Court as already the occasion to consider the<\/p>\n<p>application for grant of anticipatory bail on merits and<\/p>\n<p>upon such consideration rejected the application as<\/p>\n<p>aforesaid. The prayer of the petitioner for grant of<\/p>\n<p>anticipatory bail was also rejected by the Apex Court and<\/p>\n<p>the Apex Court while dismissing the application had<br \/>\n            observed that in case petitioner surrenders in the Court<\/p>\n<p>           below and makes an application for bail the same shall be<\/p>\n<p>           considered on the same day. The petitioner did not choose<\/p>\n<p>           to surrender and kept continuing making his attempt to<\/p>\n<p>           get anticipatory bail.\n<\/p>\n<p>                       It is further submitted on behalf of the petitioner<\/p>\n<p>           that the second time the petitioner had moved for<\/p>\n<p>           anticipatory bail before the Sessions Judge on account of<\/p>\n<p>           certain development in the case.\n<\/p>\n<p>                       Learned counsel for the opposite party no.2, on<\/p>\n<p>           the contrary, submits that there was no material for filing<\/p>\n<p>           the second anticipatory bail application.<\/p>\n<p>                       Considering the rival submissions of the parties<\/p>\n<p>           and the nature of allegations as well as the fact that this<\/p>\n<p>           Court has earlier considering the nature of allegation and<\/p>\n<p>           the materials on record declined the request of the<\/p>\n<p>           petitioner and further that the prayer of the petitioner was<\/p>\n<p>           also not accepted by the Apex Court and accordingly the<\/p>\n<p>           S.L.P. moved by the petitioner was dismissed, I do not find<\/p>\n<p>           any material worth considering to allow the prayer in this<\/p>\n<p>           application.
