( Oral )<\/p>\n<p>             The petitioner has filed this petition under Articles 226\/227 of<\/p>\n<p>the Constitution of India for setting aside the election of respondent No.5 as<\/p>\n<p>Sarpanch of Gram Panchayat Village Malakpur, Tehsil Payal, District<\/p>\n<p>Ludhiana, on the ground that respondent No.5 Jaswinder Kaur, has been<\/p>\n<p>declared as Sarpanch, in spite of the fact that the office of Sarpanch of the<\/p>\n<p>aforesaid Gram Panchayat was reserved for Scheduled Caste (Male).<\/p>\n<p>             After arguing for some time, counsel for the petitioner states<\/p>\n<p>that in view of the disputed questions of facts raised in this writ petition and<\/p>\n<p>urther in view of the decision of this Court in <a href=\"\/doc\/19439952\/\">Baljit Singh v. State of<\/p>\n<p>Punjab and others (CWP No.<\/a> 13643 of 2008, decided on August 22, 2008),<\/p>\n<p>wherein it has been held that in view of Clause (b) of Article 243-O of the<br \/>\n<span class=\"hidden_text\"> CWP No. 14217 of 2008                                               -2-<\/span><\/p>\n<p>fConstitution of India and Section 74 of the Punjab State Election<\/p>\n<p>Commission Act, 1994 (hereinafter referred to as `the Act&#8217;), election of<\/p>\n<p>Sarpanch is to be challenged by filing an election petition under section 76<\/p>\n<p>on the grounds mentioned in Section 89 of the Act, the petitioner may be<\/p>\n<p>permitted to withdraw this petition with liberty to avail the remedy of<\/p>\n<p>election petition.\n<\/p>\n<p>             Dismissed as withdrawn with the aforesaid liberty.<\/p>\n<p>             However, if the election petition is filed by the petitioner in<\/p>\n<p>accordance with law, the Election Tribunal is directed to decide the same<\/p>\n<p>expeditiously.<\/p>\n<pre>\n\n\n                                       ( SATISH KUMAR MITTAL )\n                                               JUDGE\n\n\nAugust 27, 2008                           ( JASWANT SINGH )\nndj                                             JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Paramjit Singh vs State Of Punjab And Others on 27 August, 2008 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH.
